Subject: RX Public Assistance COVID-19 FEMA Daily Update 5.1.2020

Good afternoon,

Happy Friday and happy first of May!   We have been getting a lot of questions from folks who have seen media stories about Public Assistance efforts in other regions, and you may also be getting inquiries. There are a lot of stories that make it sound like PA is funding new types of costs, particularly around feeding and sheltering, that we would not have considered eligible in the past; this is not the case. All Category B costs, like always, must meet all the standard criteria: be required as a direct result of the event, be directly tied to eligible EPM, and the costs must be reasonable based on the conditions at the time the costs were incurred. While we are able to expedite funding up front, the projects, like always, will need to be reconciled on the back end and will be subject to audit. For initial funding, we don't need documentation, but we do need a pretty robust and detailed understanding of what the eligible costs actually are, and then we can follow up with documentation.  Here in Region X, we are trying to find the right balance between speed and accuracy, and to build a sustainable operation for the long haul. Please let us know any questions or issues and we'll work through them as they arise.

SLTT Applicants that want to purchase PPE in bulk for distribution: SLTT Applicants can purchase PPE and distribute it to public and private medical care facilities, and be reimbursed by PA at the prevailing cost share. However, an eligible Applicant could not procure PPE on behalf a private business and be reimbursed by PA. See also the agency's guidance on purchase of PPE in the Emergency Medical Care Fact Sheet.  FEMA and HHS are working together to distribute cloth facial coverings as part of a multi-prong approach to re-open American economic activity while continuing to limit spread of COVID-19 through direct federal assistance.

Also regarding PNPs, only eligible PNP medical care facilities treating COVID-19 patients would be eligible for PPE. Purchase of PPE is only eligible as an emergency protective measure. For PNPs, emergency protective measures are generally limited to activities to prevent damage to its eligible facility. This is because emergency services are usually the legal responsibility of SLTT governments. In limited circumstances, FEMA may reimburse a PNP directly when essential components of a facility are urgently needed to save lives or protect health and safety, such as an emergency room of a PNP hospital. See PAPPG V3.1, Chapter 2:VI.B. For COVID-19 declarations, eligible PNP medical care facilities providing treatment to COVID-19 patients would be eligible to request reimbursement for medical care services including the purchase of PPE. Any other PNP facility would not be eligible under PA for PPE.

Request for information ESF 4, AFG-S funding: Please see the attached application for the 2020 AFG-S Grant funded by the CARES Act for fire departments needing PPE.

Federal Assistance for Senior home delivery from Restaurants: It was brought to our attention that California<https://abc7.com/california-senior-meal-home-delivery-program-fema-partnership-governor-gavin-newsom/6127425/> has been advertising a home food delivery resource for Seniors. Like with all potentially eligible Category B costs, an eligible jurisdiction that's legally responsible for feeding folks as a result of COVID can meet those needs in any number of ways and we can reimburse them as long as they meet the standard criteria. In this case, it appears that the state is contracting with restaurants; this is no different than contracting with food banks to supply food. Please let us know if you have any further questions.

FEMA Assistance for Tribal Governments FAQs: In response to inquiries received from the Regions, the attached Coronavirus Pandemic: FEMA Assistance for Tribal Governments FAQs provides answers to frequently asked questions about FEMA assistance options for federally recognized tribal governments responding to the COVID-19 pandemic.  Content includes the programmatic differences of an emergency declaration, major disaster declaration, and a tribe as a Recipient or as a Subrecipient.
