The Oregon Statutes define career school as "any private proprietary professional, technical, home study, correspondence, business or other school instruction, organization or person that offers any instruction or training for the purpose or purported purpose of instructing, training or preparing persons for any profession". Nursing assistant training programs meet the definition of private career schools. Schools, that the Superintendent of Public Instruction determines are adequately regulated by other means to guarantee that the school meets the standards of ORS 345.325, may be exempted from ODE licensure. Thus, Board staff has been working with ODE staff and stakeholders over the last year on drafting Division 61 rule language to meet the standards of ORS 345.325. Attached is a draft of rule revisions to Division 61 of the Nurse Practice Act to add stronger language related to student protections. The plan is to take this draft to the Board in April for first reading with the intention of having a hearing in June. It is our understanding that if the Board adopts this language, ODE will have a simple form with no fee for the nursing assistant training programs to use to apply for an exemption from ODE licensure. The exemption is available only to those programs that offer only nursing assistant or medication aide training. Any program that offers other training courses in addition to their nursing assistant/medication aide training will still need to be licensed through the ODE in addition to having regulatory oversight by the Board. As a result of those two meetings, a draft of proposed changes to the Board's curriculum policy is attached for your review along with related proposed changes to Division 61 of the Nurse Practice. The proposed changes are modeled off of the National Council of State Board's of Nursing (NCSBN) 2007 Medication Assistant-Certified (MA-C) Model Curriculum. A copy of the NCSBN Model Curriculum is attached for your convenience. The changes to Division 61 would: 1) Remove a barrier in the qualifications for the program director and primary instructor of medication aide training programs. 2) Broaden clinical preceptor qualifications for the medication aide training program clinical experience. 3) Increase the classroom/lab hours for medication aide training programs. 4) Simplify the language related to the process for the student progression during the clinical experience in medication aide training programs.
