Dear Partners,
The Oregon Commission for the Blind is revising and updating rules that will supplement the governing law of the Randolph-Sheppard Act*. These updated rules reflect changes made to Oregon law by the 2017 Oregon legislature (HB 3253), and include new incentives for Blind Enterprise Program vendors to offer "healthy" items for sale at cafeterias, snack bars, and vending machines located in state and local public buildings. Proposed rules expand the definition of public building or property to include property owned, leased or occupied by city or county government and community colleges.
Creating environments where healthy foods and beverages are available is an effective way to ensure government employees, visitors and clients have the opportunity to make choices that support their health. The Public Health Division supports use of the 2015-2020 Dietary Guidelines for Americans as the standard for defining foods and beverages as "healthy".
The proposed rules define two categories of items that could be labeled "healthy":
HEALTHY ITEMS (OTHER): These are products offered at cafeterias and snack bars. These items meet the guidelines specified in the USDA Health and Sustainability Guidelines for Federal Concessions and Vending Operations which are aligned with the 2015-2020 Dietary Guidelines for Americans.

HEALTHY VENDING ITEM: These are products offered in vending machines. These items meet the guidelines specified in the USDA Health and Sustainability Guidelines for Federal Concessions and Vending Operations which are aligned with the 2015-2020 Dietary Guidelines.

* The Randolph-Sheppard Act is federal legislation that regulates the Randolph-Sheppard Vending Facility Program, which provides persons who are blind with remunerative employment and self-support through operation of vending facilities on federal and other property. In Oregon, the Business Enterprise Program is administered by the Oregon Commission for the Blind under the Randolph-Sheppard Act, which covers federal properties and any building, land or other real property owned, leased or occupied by any department or agency of the State of Oregon.
