Dear Erin,
January is Stalking Awareness Month and National Slavery and Human Trafficking Prevention Month. As we begin 2012, whether we are talking of these or other crimes, victims face a myriad of attacks on their privacy, protection, and participation in justice.  We can best face new and enduring challenges by building on the successes of years past (photos celebrating our work in 2011 are on NCVLI's Facebook page - check them out! ) and growing the country's capacity to serve victims. Fighting for Victim Privacy on the New Frontier of Social Media

Subpoenas for victim records are not new.  Sadly, neither are attacks on a rape victim's credibility through arguments that the victim is not "acting like a victim".  What is new, however, are the kinds of records being sought.  Over the last year, NCVLI has worked with numerous partners to protect victims from invasions of the newest target -- their social media and text message accounts.  In the most recent case, a military defendant, in possession of a photograph of the victim at the hospital that was posted on Facebook, is arguing that because the victim is smiling in the photo, she was not raped.  Defendant is using this photograph as a basis to subpoena the victim's entire Facebook account, arguing that there may be other revealing photographs there. This argument is built upon a number of common rape myths, including the idea that there is a stereotypical or model rape victim.  These arguments can be fought on many of the same grounds as other subpoenas: relevancy, admissibility, privacy, and other victims' rights. NCVLI's Safeguarding Child-Victims' Rights Initiative Launches Training

Child-victims of crime face unique challenges. From the myriad of legal systems that may be involved, to the developmental differences in children, protecting a child-victim's rights presents unique hurdles for advocates.

As part of NCVLI's commitment to furthering the rights of child-victims of crime, the Safeguarding Child-Victims' Rights Initiative has spent the past year working with an eleven-member multidisciplinary curriculum committee to develop an intensive two-day, skills-based training on how to provide effective rights enforcement representation to child-victims of crime.  The pilot launch of the training will take place at Lewis & Clark Law School on February 24th and 25th.  Two additional trainings will be offered in locations across the country in the Spring and Summer of 2012.

Remembering and Honoring a Hero

On January 6, 2012, the victim community lost a hero.  Ellen Pence, a scholar and a social activist, taught us to reconceptualize domestic violence. She also revealed that we learn the most when we ask survivors about their truth. As this new year begins, we celebrate the life and work of Ellen Pence and to we commit to continuing to learn from her.
