Scrolling down towards the bottom, one needs to locate the information regarding what constitutes a historic cemetery (burial prior to Feb. 1 1909), however, as you have stated that this is also considered a private cemetery with Indian Remains, you may have to work something out with how the law is written, and thus, access.

You may need to contact someone at your local govt / county office for assistance in this matter.
