Dispute Resolution Update:
A. Complaint Resolution Process
Disciplinary removal for student not yet identified. The District suspended
N.D. indefinitely for making threats and required the parent to obtain a
risk assessment before N.D. could return to school. At the time of this
suspension, the District was evaluating N.D. for eligibility as a student
with autism spectrum disorder. The Department concluded that the District
"had knowledge" that N.D. was a student with a disability at the time of the
suspension and should have provided all of the procedural safeguards under
the IDEA, including a determination of whether the behavior was a
manifestation of the student's disability. The Department also concluded
that the District did not appropriately expedite the evaluation and IEP
development, and that home instruction was not an agreed-upon alternative to
continued school placement. The Department found no violations for K.D.
because at the time of her suspension the District had no reason to suspect
a disability and the parent had not requested an evaluation.

IEP implementation for student transferring from middle school to high
school. The Department found the District did not take appropriate steps to
transition student with autism from middle school to high school, and unduly
delayed completing evaluation of sensory needs necessary to provide
appropriate program for him. The Department did not substantiate
allegations relating to lack of supervision and other issues.
