Here is more detailed information: This year: * If you have already sent your summer reading materials to the printer, don't worry about it. Use them. It's OK this year. * If you are down to the wire and don't have time to swap the CSLP artwork or clipart from the manual, send it to the printers as you planned. It's OK this year. * If you have time to swap out the CSLP art for public domain clipart on your summer reading materials, please do so. * If you are photocopying/printing materials from the summer reading manual, that is OK. That's what the manual is for. * If you are purchasing posters and materials from Highsmith, then sending them to have your library information printed on them. It's OK. * If you are printing/photocopying the same posters, bookmarks, and materials sold by Highsmith, you need to purchase these from Highsmith. Oregon Summer Reading Certificates this year: There are no changes, and should be going out to the libraries that ordered them the first week of June as planned. They are not in compliance with the Rules of Use. However, I spoke with CSLP and Highsmith about the Oregon Summer Reading Certificate, I filled out and submitted a "Customized Paper Product Order" form, and received permission to create and print them in-house this year. Next year: Libraries can still design their own paper products; you do not have to purchase Highsmith products from the catalog. There are two other options: 1) Create your own paper materials using the CSLP artwork or clip-art just like you have done in the past, complete a "Customized Paper Product Order" form and submit it to Highsmith. Highsmith will either print it for you or they will refuse it. The Rules of Use state that if Highsmith refuses to print your customized paper product they should give you permission to print it in-house. It is too late to do this for the 2010 summer reading program. I will send out the "Customized Paper Product Order" form via email this Fall for the 2011 summer reading program. This is the process we will use for the Oregon Summer Reading Certificate next year. 2) Create your own materials using artwork/clip-art from another source. In this case you could use clipart in the public domain such as what you find from windows clipart to create your own logs. Another example, some Oregon libraries use the CSLP slogan and theme (water, "Make a Splash--READ!") However, they contract with a local artist to design different art and use their own art on all summer reading materials. As you know, Ready to Read funds may only be used for the statewide reading program and this counts because these libraries still use the CSLP theme and slogan. A few things to keep in mind: CSLP is not the copyright police. The CSLP Rules of Use are designed to make Highsmith's copyright rules more understandable to libraries, and to help libraries move towards compliance. If you aren't sure your library is in compliance with the Rules of Use and you are facing a short timeline, keep working as you originally planned so you can meet your deadline, but please send me and email or give me a call. CSLP has an RFP process to contract with an exclusive vendor, Highsmith is the vendor that was awarded the current contract. There will be a full RFP process when the contract is up, and Highsmith will have to submit another RFP just like all other interested vendors. When did the change in rules come about? Has this been in the works for a while or have the rules always stated this? As far as I know, this has always been the rule. The Rules of Use did not clearly explain it so lots of libraries all over the country have not been in compliance and didn't know it. Therefore, the Rules of Use were clarified this year to help libraries comply. Was there lots of discussion at the CSLP? There was some discussion in the Rule of Use Committee meeting. It was primarily around the process and time line for completing the "Customized Paper Product Order" form and submitting it to CSLP so we will be able to help libraries through this process next year. This is the process that should allow you to create your own reading logs as you have in the past. How are other states feeling? I don't know because there was not a lot of discussion around this. At the Rules of Use Committee meeting most people were concerned that Highsmith doesn't know how many libraries are not in compliance with this Rule, and they will be surprised by how many more Customized Paper Product Orders there will be next year. A few people who attended the Rules of Use Committee meeting said they hope that Highsmith is overwhelmed by the number of Customized Paper Product Orders because it may present an opportunity to discuss making some changes to this Rule. Could you please provide some background about how these rules of use evolved? As I understand it, the Rules of Use were created to help libraries understand copyright of Highsmith's summer reading products. The Rules of Use are revised on an ongoing basis to provide more clarification of copyright on summer reading products, and help libraries move towards compliance. It's OK this year. * If you are down to the wire and don't have time to swap the CSLP artwork or clipart from the manual, send it to the printers as you planned. It's OK this year. * If you have time to swap out the CSLP art for public domain clipart on your summer reading materials, please do so. * If you are photocopying/printing materials from the summer reading manual, that is OK. That's what the manual is for. * If you are purchasing posters and materials from Highsmith, then sending them to have your library information printed on them. It's OK. * If you are printing/photocopying the same posters, bookmarks, and materials sold by Highsmith, you need to purchase these from Highsmith. Oregon Summer Reading Certificates this year: There are no changes, and should be going out to the libraries that ordered them the first week of June as planned. They are not in compliance with the Rules of Use. However, I spoke with CSLP and Highsmith about the Oregon Summer Reading Certificate, I filled out and submitted a "Customized Paper Product Order" form, and received permission to create and print them in-house this year. Next year: Libraries can still design their own paper products; you do not have to purchase Highsmith products from the catalog. There are two other options: 1) Create your own paper materials using the CSLP artwork or clip-art just like you have done in the past, complete a "Customized Paper Product Order" form and submit it to Highsmith. Highsmith will either print it for you or they will refuse it. The Rules of Use state that if Highsmith refuses to print your customized paper product they should give you permission to print it in-house. It is too late to do this for the 2010 summer reading program. I will send out the "Customized Paper Product Order" form via email this Fall for the 2011 summer reading program. This is the process we will use for the Oregon Summer Reading Certificate next year. 2) Create your own materials using artwork/clip-art from another source. In this case you could use clipart in the public domain such as what you find from windows clipart to create your own logs. Another example, some Oregon libraries use the CSLP slogan and theme (water, "Make a Splash--READ!") However, they contract with a local artist to design different art and use their own art on all summer reading materials. As you know, Ready to Read funds may only be used for the statewide reading program and this counts because these libraries still use the CSLP theme and slogan. A few things to keep in mind: CSLP is not the copyright police. The CSLP Rules of Use are designed to make Highsmith's copyright rules more understandable to libraries, and to help libraries move towards compliance. If you aren't sure your library is in compliance with the Rules of Use and you are facing a short timeline, keep working as you originally planned so you can meet your deadline, but please send me and email or give me a call. CSLP has an RFP process to contract with an exclusive vendor, Highsmith is the vendor that was awarded the current contract. Gale has decided to move all K12 Resource Center products to that interface at the same time instead of staggering the transition. One of the main reasons for joining this cooperative was the ability to obtain high quality art work that would have been unaffordable for Oregon to obtain on its own. However, the strength of branding is negated when libraries are not allowed to use that artwork to create their summer reading materials. I know from when I was the CSLP rep that Highsmith enjoys a really wonderful return on the investment it makes of time and money to produce these materials. I also know that CSLP benefits with a percentage kickback from Highsmith that can be used to reinvest in continuing this venture from year to year. I don't think that either entity would find participation in future years unaffordable if this rule was changed. Perhaps total income would go down but making this program work for libraries with smaller reading club budgets should be an important aspect as well. Finally, if this is untenable to Highsmith, we all know of other vendors who might be interested in collaborating with CSLP, even with the change in clip art rules. While I'm not advocating for moving from Highsmith as our vendor, I do think that the rules for use of clip art are in drastic need of change. If my assessment of this situation doesn't accurately reflect the views of youth services librarians around the state, please do weigh in on the subject. While there was not much discussion this year at the meeting regarding copyright issues and reading logs, perhaps that was because many of the State representatives were unaware of how many libraries prefer to create their own reading logs and/or certificates using the CSLP artwork. This definitely sounds like something that will be brought for discussion by your Oregon representatives at this next year's meeting and is exactly the kind of feedback we need to have for representing Oregon at the CSLP national meetings. The past years that I have attended, Oregon representatives have successfully lobbied for the themes, slogans, and other items of interest that Oregon librarians have expressed as being their top concerns so please know that your voices are being heard and that your state representative (Katie Anderson) and Summer Reading Chair are definitely working hard to make sure that Oregon is well represented. Also, please remember if you are passionate about these issues, you are always able to volunteer for one of the CSD board positions including that of CSD Summer Reading Chair and Chair elect which is the position that attends the annual Collaborative Summer Library Programs meeting. However, the strength of branding is negated when libraries are not allowed to use that artwork to create their summer reading materials. I know from when I was the CSLP rep that Highsmith enjoys a really wonderful return on the investment it makes of time and money to produce these materials. I also know that CSLP benefits with a percentage kickback from Highsmith that can be used to reinvest in continuing this venture from year to year. I don't think that either entity would find participation in future years unaffordable if this rule was changed. Perhaps total income would go down but making this program work for libraries with smaller reading club budgets should be an important aspect as well. Finally, if this is untenable to Highsmith, we all know of other vendors who might be interested in collaborating with CSLP, even with the change in clip art rules. While I'm not advocating for moving from Highsmith as our vendor, I do think that the rules for use of clip art are in drastic need of change. If my assessment of this situation doesn't accurately reflect the views of youth services librarians around the state, please do weigh in on the subject. As those of you who attended the Spring CSD meeting or the past two OYAN meetings know, the Oregon State Library with support from the Oregon Library Association is partnering with the Oregon College Savings Plan to offer the 2010 Oregon Summer Reading Sweepstakes. Yesterday the State Librarian sent an email to all public library directors announcing the Sweepstakes-I've copied the email and pasted it below so you have the same information as your director. Here are some important details that you need to know: ? Sweepstakes materials are going out to all libraries starting June 1st. Libraries in the Portland metro area will probably receive them from via Admail delivery service, all other libraries will receive them via UPS. Look for a large, flat box with a dolphin sticker on it. ? Central/administrative libraries will receive all materials for your system, please distribute the materials to your branches. ? The Sweepstakes is designed to be flexible so you may administer it whatever way works best with your summer reading program. You may use all of the materials provided or only those that work with your program. The Sweepstakes is not mandatory so libraries may choose not to participate. ? But it is also true that this year and last year, we have liked only a few of the individual clip art graphics and have disliked several of them and chosen not to use them anyway. So many libraries or states might be happy with lower cost art from lesser known artists? We originally joined in order to save the library staff members who worked on the Summer Reading Committee a lot of work (we did the theme, found the artist, and everything). By joining CSLP, we were able to get high quality artwork and join in a more national theme. If our young patrons were visiting from out of state, they often recognized the artwork that their home library was using. It was great. This change to a corporation controlling us and our message is very disheartening. It was not the intent with which we joined CSLP. When I heard how much Highsmith controls, it made me physically cringe. I understand that Highsmith is now doing the legwork with the artist and paying the artists? fees. Maybe the CSLP should step back from this model and do as Debra suggests and hire unknown artists who listen to our needs and wants instead of those of the corporation. I concur with Debra that there are many years (this included) where I don?t use any of the artwork, or in a very limited manner, due to the juvenile quality of the YA artwork. The goat? Please! I don?t want to leave CSLP. I would like CSLP to take their power back. Highsmith makes a lot of money off of this program. If they would relinquish control over the printed pieces, I might feel more inclined to purchase more items from them, as I have done in the past years. This year, I purchased less than $50 worth. Our communities are all different, and part of providing exceptional library service is understanding those difference and working with our communities to find a summer reading log and certificate that will encourage reading and help our young customers feel successful. This summer I printed 2,500 reading logs, which I realize isn't a big number for some libraries. This would cost me $150 from Upstart. I frankly don't care about the loss of revenue for Upstart. They are a business, and they make a lot of money. They can continue making money off t-shirts and posters, and I do appreciate the wonderful art work (for kids). My ever-shrinking summer reading budget is significantly impacted by spending $150 on reading logs. Also, what if I were to run out of Upstart reading logs? At our library we can have a run on them and I need the flexibility to run upstairs and make more copies. Furthermore, this is a hassle. The prospect of mocking up a reading log for Upstart 9 months before I need it, so I can submit it to their department and then wait for approval, or not, is time consuming. Highsmith needs to understand our needs as customers and provide exceptional service by recognizing how libraries need to serve their customers. Or we need to find a company that will. There's my frustrated rant. Or can we order more the moment we receive the materials and find out how many entries we received? Provide Sweepstakes entries to kids/parents whenever it works best with your program. Some of you may give them out when kids sign-up, some may give them out to kids when they finish, and others may pass them out at special summer reading events or programs. As those of you who attended the Spring CSD meeting or the past two OYAN meetings know, the Oregon State Library with support from the Oregon Library Association is partnering with the Oregon College Savings Plan to offer the 2010 Oregon Summer Reading Sweepstakes. Yesterday the State Librarian sent an email to all public library directors announcing the Sweepstakes-I've copied the email and pasted it below so you have the same information as your director. Then, during the time we were partnering with Metropolitan Group, we had great art and materials which were much more expensive, and ended up with an enormous debt which took two years+ to resolve. I don't want to go back to those days. This would mean taking a giant step back in summer reading. I am extremely disappointed to hear that Highsmith basically wants to have a monopoly on anything CSLP. I know that the company will use the art again, at least a year later, for a more general reading promotion. Are they afraid that all of us are going to dig out our CD's from years past and incorporate the artwork once again? Are they afraid they are going to miss a buck? Highsmith makes a lot of money from the CSLP. A lot of money! One of the biggest reasons for joining CLSP is have access to high quality artwork and a complete summer reading manual. Libraries on a small budget/no budget were able to produce high quality summer reading materials and programs. Some libraries do purchase a lot of materials, others do not. That's OK. Does Highsmith think they are not selling as much CLSP material because we are creating our own? Are sales down this year? Of course, library budgets are down this year as well. Is Highsmith reacting to the economy and taking it out on CLSP? Has anyone talked with the Executive Board of CLSP to let them know what kind of hardship the limitation of use of the art will be? So many libraries across the nation are facing bigger and bigger finanacial cuts and the CLSP is one thing that has been affordable, optional to use and helps create support for libraries on a united front both statewide and nationwide. Also, I don't know if Highsmith would enjoy having negative press about something such as Summer Reading. I remember, when CLSP was small they had a much stronger voice because Highsmith wanted their business. This situation makes me feel as if Highsmith has taken over the CLSP program and they now call the shots. Say this isn't so. I don't think that either entity would find participation in future years unaffordable if this rule was changed. Perhaps total income would go down but making this program work for libraries with smaller reading club budgets should be an important aspect as well. Finally, if this is untenable to Highsmith, we all know of other vendors who might be interested in collaborating with CSLP, even with the change in clip art rules. While I'm not advocating for moving from Highsmith as our vendor, I do think that the rules for use of clip art are in drastic need of change. As a result, school districts now have to indicate how they are planning for a ?strong school library program? as part of the district continuous improvement plan (CIP) that they submit every other year. A sub-committee of OASL worked with ODE, the Oregon Department of Education, to help draft the library questions for the CIP and has asked to be included in writing the language for the library portion of the OAR, or Oregon Administrative Rule. Esther, Paige, Heidi and I (your CSLP reps) have been saving your feedback, and encourage you to continue the discussion online so we can get more input from more Oregon librarians. The four of us have started discussing how to compile your feedback and use it to start a discussion with other state representatives prior to the next CSLP meeting. Our hope is that other states will start collecting feedback from their libraries to bring to the next CSLP meeting too. Then, we can approach the CSLP Executive Board together. As Karen Fischer said in an earlier email on this topic, we need to speak with a united voice. The better we understand the current Rules of Use the better we can advocate for change. Several comments have been made around who owns the copyright. Just to clarify, the introduction to the Rules of Use state that the artists owns the copyright to their work, and the vendor negotiates with the artists for exclusive use of their art for both CSLP members and the vendor. This arms our representatives to better support Oregon Libraries. I know I have been frustrated at the limitations in how we produce reading logs, brochures, etc. for Salem Public Library. In my opinion, we would be so much better served if the artist's copyright agreement included use of all Summer Reading Art by member libraries for any summer reading related marketing materials (brochures, reading logs, booklists, etc.) for the year in which the Artwork is featured, without the vendor (Highsmith or another) controlling everything. We actually joined the Collaborative the year I was the CSD chair and looking for ways to save the Oregon Statewide Summer Reading Program.Debra's year was the first full year of implementation in Oregon. I'm not sure how far we want to go back into the reasons we joined CLSP but at the time we did, joining CLSP saved the Oregon Statewide Summer Reading Program. Prior to being a member of CLSP Oregon had been originally been doing our own statewide manual which required a lot of energy, time, travel and work and wasn't always the best. Then, during the time we were partnering with Metropolitan Group, we had great art and materials which were much more expensive, and ended up with an enormous debt which took two years+ to resolve. I don't want to go back to those days. This would mean taking a giant step back in summer reading. I am extremely disappointed to hear that Highsmith basically wants to have a monopoly on anything CSLP. I know that the company will use the art again, at least a year later, for a more general reading promotion. Are they afraid that all of us are going to dig out our CD's from years past and incorporate the artwork once again? Are they afraid they are going to miss a buck? Highsmith makes a lot of money from the CSLP. A lot of money! One of the biggest reasons for joining CLSP is have access to high quality artwork and a complete summer reading manual. Libraries on a small budget/no budget were able to produce high quality summer reading materials and programs. Some libraries do purchase a lot of materials, others do not. That's OK. Does Highsmith think they are not selling as much CLSP material because we are creating our own? Are sales down this year? Of course, library budgets are down this year as well. Is Highsmith reacting to the economy and taking it out on CLSP? Has anyone talked with the Executive Board of CLSP to let them know what kind of hardship the limitation of use of the art will be? So many libraries across the nation are facing bigger and bigger finanacial cuts and the CLSP is one thing that has been affordable, optional to use and helps create support for libraries on a united front both statewide and nationwide. Also, I don't know if Highsmith would enjoy having negative press about something such as Summer Reading. I remember, when CLSP was small they had a much stronger voice because Highsmith wanted their business. This situation makes me feel as if Highsmith has taken over the CLSP program and they now call the shots. Say this isn't so. I hope enough states are speaking up to both CLSP and Highsmith this is not acceptable. Hi all- I agree with BJ; my memory, from serving as CSD chair the year that Oregon joined the collaborative, is that originally CSLP did solely own the copyright to the art and did not own it jointly with Highsmith. So I believe that has changed over the years. I agree that many libraries, including ours, are or could be easily priced out of the market with Highsmith?s materials. We don?t use reading records, but if we did have to purchase the 7500+ that we?d need, it would put a large dent in either our programming or the number of free books we could give away. Perhaps the cost of using a well-known illustrator has sky-rocketed in the past five years. But it is also true that this year and last year, we have liked only a few of the individual clip art graphics and have disliked several of them and chosen not to use them anyway. So many libraries or states might be happy with lower cost art from lesser known artists? Hi Katie, I am supposed to be out of the summer reading loop but can't contain my thoughts on this, in spite of trying really hard. I would like to see delegates to CSLP actively lobby for changes to this rule. There seems to be less validity in participating in a cooperative that disallows use of the summer reading program clip art for customized reading logs, final certificates, etc. While I understand that Highsmith would like to be sole source for all things reading club, their pricing doesn't make it possible for many, many libraries to order their products. While I value things that many libraries would never be able to afford - a large vinyl banner in full color, a variety of t-shirts sporting the summer theme, full color bookmarks - I question the wisdom of CSLP negotiating a contract that won't allow a small library to print off reading logs or certificates on their photocopier using that summer's clip art. One of the main reasons for joining this cooperative was the ability to obtain high quality art work that would have been unaffordable for Oregon to obtain on its own. However, the strength of branding is negated when libraries are not allowed to use that artwork to create their summer reading materials. I know from when I was the CSLP rep that Highsmith enjoys a really wonderful return on the investment it makes of time and money to produce these materials. I also know that CSLP benefits with a percentage kickback from Highsmith that can be used to reinvest in continuing this venture from year to year. I don't think that either entity would find participation in future years unaffordable if this rule was changed. Perhaps total income would go down but making this program work for libraries with smaller reading club budgets should be an important aspect as well. Finally, if this is untenable to Highsmith, we all know of other vendors who might be interested in collaborating with CSLP, even with the change in clip art rules. While I'm not advocating for moving from Highsmith as our vendor, I do think that the rules for use of clip art are in drastic need of change. If my assessment of this situation doesn't accurately reflect the views of youth services librarians around the state, please do weigh in on the subject. I certainly haven't taken the time to make calls and survey librarians around the state. My two (long-winded) cents.... Both the clip-art in the manual and by the artists can be used for products that do not duplicate what Highsmith currently offers. The clarification is around what is considered a duplication of paper products. For example, many libraries around the country have different reading goals/records, therefore the reading records offered by Highsmith don?t work for them. In the past we thought it was OK to use the clip-art to create our own reading record because Highsmith didn?t offer a similar reading record. This year we learned that since Highsmith offers a reading record we can?t use the clip-art to create a different type of reading record. We can still use the art on sign-up forms, events calendars, booklists, event promotions/signs/brochures, and other materials not available to purchase from Highsmith/Upstart.
