Federal court says FCC lacks authority to uphold net neutrality in Comcast

The U.S. Court of Appeals for the District of Columbia has
ruled<http://www.wo.ala.org/districtdispatch/wp-content/uploads/2010/04/comcastfcc.pdf>that
the Federal Communications Commission (FCC) lacks the authority to
require broadband providers to give equal treatment to all Internet traffic
flowing over their networks.

The ALA believes the Internet faces major threats as a result of
deregulation and has voiced
support<http://www.wo.ala.org/districtdispatch/?p=4246>for FCC’s
efforts to maintain an open Internet by codifying the principles
of network neutrality.  The ALA Washington continues to analyze the
implications of the court ruling and is planning next steps.

The ALA is slated to file comments to FCC tomorrow as part of the Open
Internet Coalition in the matter of Preserving the Open Internet Broadband
Industry Practices, which are currently due tomorrow.
