BOARD RULEMAKING NOTICE

Please find attached the following rulemaking documents from the Board of Psychology.
1)      Notice of Proposed Rulemaking
Rule Caption: Pain management and suicide risk continuing education requirements and failure to comply.
Rule Summary:
Amend OAR 858-040-0015: This amendment changes Board licensees' requirements for pain management continuing education from a one-time mandate for new licensees to a one-credit ongoing requirement for all licensees, and adds a new requirement for licensees to complete four credits of continuing education dedicated to the topic of suicide risk assessment, treatment, and management.
Amend OAR 858-040-0055: This makes conforming amendments to implement the change in requirement for pain management continuing education.
Amend OAR 858-040-0070: This amendment clarifies that licensees' failure to comply with continuing education requirements is considered unprofessional conduct.
The agency requests public comment on whether the options should be considered for achieving the rule's substantive goals while reducing negative economic impact of the rule on business.  Please email your comments to laree.felton at mhra.oregon.gov<mailto:laree.felton at mhra.oregon.gov> or mail them to the Board's office at 3218 Pringle Road SE, Ste. 130, Salem, OR 97302.  All comments must be received no later than 5:00 p.m. on October 26, 2021.
2)      Permanent Administrative Order (filed 9/22/21; effective 1/1/22)
Rule Caption: Psychologist associate licensure sunset and doctoral education cleanup.
Rule Summary:
Amend OAR 858-010-0010: This amendment removes some old rule language that has become obsolete, and does minor reorganization for clarity.
Amend OAR 858-010-0012: This amendment implements House Bill 2117 by removing reference to OAR 858-010-0015 which is being repealed.
Amend OAR 858-010-0013: This amendment implements House Bill 2117 by removing reference to OAR 858-010-0015 which is being repealed.
Repeal OAR 858-010-0015: This rule is proposed to be removed in order to implement House Bill 2117, which repeals the Board's authority to issue new psychologist associate licenses.  The psychologist associate educational requirements will no longer be needed because the Board will no longer accept applications for psychologist associate licensure as of the January 1, 2022 effective date.
Amend OAR 858-010-0016: This amendment implements House Bill 2117 by removing reference to OAR 858-010-0015 which is being repealed.
Amend OAR 858-010-0034: This amendment implements House Bill 2117 by removing reference to applicants for psychologist associate licensure as of January 1, 2022.
Amend OAR 858-010-0056:  This amendment implements House Bill 2117 by removing reference to applicants for Temporary Psychologist Associate Authorization as of January 1, 2022.
