The temporary rule took effect on January 1, 2012. By eliminating the commercial vessel exemption, commercial passenger vessels less than 100 gross tons must abide by, and cannot be exempted from, rules enacted by the Oregon State Marine Board in waters of the state when there are no conflicting federal waterway rules or regulations. The meeting is concurrent with the Portland Sportsmen's Show and will be from at 8 a.m. to 10 a.m. in Room 204, Hall D, of the Portland Expo Center. The public is welcome to attend and an opportunity for public comment will be provided at 9:45 a.m. The Guide Advisory Committee is defined in statute to "provide advice to the board on various matters regarding the implementation" of outfitter & guide laws and rules. The committee was instrumental in developing a series of changes to the Marine Board's outfitter & guide program. A public meeting on the issue will be held in Portland on March 20 and will accept public testimony. The first proposal establishes a safety zone adjacent to the Sellwood Bridge construction project. The rule will close boating in the area directly beneath the temporary work bridges which may create unusual and significant hazards to recreational boaters. The rule would create a slow-no-wake zone through the construction area. This rule will sunset at the completion of construction in December 2015. The rule does not prevent commercial or recreational navigation up or down the river. The Marine Board seeks public comment on whether other options should be considered for achieving the rule's substantive goals while reducing the negative economic impact of the rule on small businesses. The second proposal amends the rule for the Holgate Channel (OAR 250-020-0280(2)) which limits boat operation in the channel and Ross Island Lagoon in Multnomah County, but specifically exempts commercial vessels. This designation is inconsistent with ORS 830.115(3)(a) which states that passenger vessels under 100 gross tons may not be exempted. The proposed rule clarifies the inconsistency by specifically exempting federally documented commercial vessels such as those operated for sand and gravel operations, but not passenger vessels of less than 100 gross tons. The third proposal clarifies the current practice of exempting federally documented commercial vessels from state numbering requirements. The exemption, which is implied in statue, will be clarified in rule. A public meeting on the issue will be held in Portland on March 20 and will accept public testimony. The first proposal establishes a safety zone adjacent to the Sellwood Bridge construction project. The rule will close boating in the area directly beneath the temporary work bridges which may create unusual and significant hazards to recreational boaters. The rule would create a slow-no-wake zone through the construction area. This rule will sunset at the completion of construction in December 2015. The rule does not prevent commercial or recreational navigation up or down the river. The Marine Board seeks public comment on whether other options should be considered for achieving the rule's substantive goals while reducing the negative economic impact of the rule on small businesses. The second proposal amends the rule for the Holgate Channel (OAR 250-020-0280(2)) which limits boat operation in the channel and Ross Island Lagoon in Multnomah County, but specifically exempts commercial vessels. This designation is inconsistent with ORS 830.115(3)(a) which states that passenger vessels under 100 gross tons may not be exempted. The proposed rule clarifies the inconsistency by specifically exempting federally documented commercial vessels such as those operated for sand and gravel operations, but not passenger vessels of less than 100 gross tons. The third proposal clarifies the current practice of exempting federally documented commercial vessels from state numbering requirements. The exemption, which is implied in statute, will be clarified in rule. The Marine Board provides boats, equipment, training, and funds for vessel maintenance to the counties who provide marine patrol services on waterbodies in each county. These law enforcement agencies patrol the waterways for compliance and safety of Oregon's boating laws. Each county has varying needs for training, equipment and maintenance. Klamath County has a fleet of ten boats that average 18 years old. The newest boat was purchased in 2005. Based on Marine Board statistics, for every 2.25 hours of patrol time on the water, deputies spend an hour on maintenance. During the period of March 1, 2011 to March 1, 2012, the marine patrol deputies reported 601.5 hours between 13 staff, on boat maintenance and 1354 on-water patrol hours. For the same timeframe, the marine patrol issued 50 boating safety citations, conducted 2,058 boat inspections, and conducted 45 boating safety courses impacting 3,117 boaters so they could be in compliance with the mandatory boater education law. The marine patrol also conducted 22 field sobriety tests, and issued 11 citations for boating under the influence of intoxicants (BUII)[cid:image009.png at 01CD06AC.617DD330]. The marine patrol deputies also participate in advanced training such as whitewater search and rescue, drift and jet boat operations, and assist training new marine patrol deputies through the Marine Board's Law Enforcement Academy. Their knowledge, training, and expertise help save lives. The Klamath County Sheriff's Office has done an outstanding job fulfilling their contract obligations by maintaining their boat fleet, conducting on-the-water patrols, and providing first rate boating safety education courses to the boating public. They do a tremendous amount of work and use the tools they are given extremely well. For a boat fleet averaging 18 years of age, this fact alone, is testament to using resources wisely. These marine deputies are dedicated, motivated, and do the best with what they have. The Marine Board supports the mission of the Klamath County Sheriff's Office and is grateful for the continued marine law enforcement services provided to the boaters of Klamath County. In addition, for every gallon of gas a boater purchases to operate their motorboat, a percentage is returned to the Marine Board who turns those dollars back to boaters in the form of boating access sites (restrooms, boat ramps, etc.), law enforcement service contracts and boating safety education. During the training, officers learn about state boating laws, rules and regulations, identify intoxicated boat operators, practiced operating their patrol boats and equipment skillfully; all while focusing on officer safety and survival. This comprehensive training includes education in the classroom and practical scenarios on the water. "This is a safe training environment that replicates situations officers will routinely experience," said Dale Flowers, Law Enforcement Training Coordinator for the Oregon State Marine Board. "It gives officers a chance to build their confidence and skills on the water." Flowers added, "Not to mention, what these students learn looks easy when they're out in the field, but in reality, these skills can take years to acquire." Many of the Marine Academy instructors are seasoned deputies who have seen and done it all. "This is the right environment for students to make mistakes and learn from them. It's an eye-opening experience, because it's really physically and mentally demanding," Flowers said. The first week of training is primarily classroom focused, learning policies and marine law. Students also spend a day in the pool learning self-rescue and survival swimming techniques, key skills in the event they are forced to enter the water. During the second week, officers hit the water to improve boat handling skills in an obstacle course and slalom run and learn on-the-water scenarios that focus on officer safety and survival. Students will practice detecting and performing standardized field sobriety testing for boaters suspected of boating under the influence of intoxicants (BUII). Scenarios include boaters portraying intoxicated operators or passengers. Students also learn what to do when encountering boaters with mechanical problems, and even more serious, life and death rescue situations under less than ideal conditions. Instructors guide students through various skill activities, and correct or critique them as needed. "Students can stay out there for as long as they need to, to feel comfortable. Being confident is a big part of the job," Flowers adds. "They've got to be able to operate a boat against the current, help a struggling victim, get them to safety, all while keeping themselves out of danger. This takes a lot of skill." The Oregon State Marine Board holds the Marine Safety and Law Enforcement (MSLE) academy each spring for newly hired marine officers. With the record-breaking rain and spring snow melt, large volumes of riverbank erosion, sediment, gravel and trees are creating significant navigation hazards for boaters. River flow characteristics change considerably with high water. The Marine Board wants to remind boaters -motorized and paddlers alike- to take the following precautions before venturing out: * Find out if the boat ramp is open. Many boating facilities are closed due to high water. Contact the waterway manager beforehand online or by phone. Many bridges also have low clearance. You can find local boating access sites and waterway manager contact information at http://www.boatoregon.com/OSMB/access/access.shtml#Where_to_Launch_in_Oregon. * Dress appropriately and make sure you're wearing a properly fitting PFD (personal flotation device). Choose wool or synthetic pile clothing and a wind/water resistant outer layer. Be sure to insulate your head, hands and feet. Most importantly, wear a PFD. All of Oregon's waterways are cold and there is a significant risk of injury due to cold water immersion and hypothermia if you suddenly find yourself in the water. A PFD will help keep your head above the water and decreases the chances of taking water into the lungs from a cold water "gasp reflex." A PFD will also help keep you warmer and give you a much better chance for self-rescue. * Almost every river from the valley to the coast in Oregon is running fast and high. Paddlecraft operators should only consider boating in groups in case help is needed. Better yet, go with an experienced guide or paddling club. Never boat alone. Use the "three boat" standard where there are white water conditions. Scout ahead for downed trees, gravel bars, and other hazards and know how to read the river. Submerged pilings, rocks, and other debris are extremely difficult to see when water levels are high and the water is churned up. With currents running fast, a log can appear out of nowhere. Use your motor for maneuverability to avoid hazards and to power against the current. * The National Weather Service has river level and river forecast information for most of Oregon's rivers. This is an excellent resource to find out the actual vs. forecasted water and current levels: http://www.nwrfc.noaa.gov/rfc/. * Fill out a float plan and leave it with a friend or relatives. Where are you going? When do you expect to be back? What activity are you doing? What are you wearing and what type of boat are you in? This is information law enforcement personnel will need to know in case of an emergency. A float plan can be downloaded from the Marine Board's website: http://www.boatoregon.com/OSMB/library/docs/FloatPlan.pdf * Do not attempt to go boating in conditions with limited visibility or near sunrise or sunset. Plan on coming in well before sunset and allow for changing weather conditions. Waiting to come in until dusk makes rescue more difficult and puts others at risk of injury as well. * Expect the unexpected. Plan for what you would do if your boat capsized. Could you pull yourself out of the water onto the boat? Should this happen, stay with the boat on the upstream side of the craft. It's much easier to spot a capsized boat than a person in swift water. If you can't stay with the boat...stay calm and catch your breath. Swim with the current at a 45 degree angle, floating with your feet pointed downstream on your back and using your arms like oars to make it to the shore safely. Avoid being pinned against obstacles or swept under the boat. Do you have a way to communicate in case of an emergency? Carry a whistle attached to your PFD, cell-phone in a zip lock/water-tight bag, or both. Taking a few minutes to think about "what if" scenarios are well worth your time. It's important to have fun, and it's important to be safe. Proper planning and preparation are all that's needed to still go out and enjoy the water, safely. The 13th Coast Guard District, Oregon State Marine Board and the Washington State Parks Boating Program remind boaters to be careful on the water this spring. In Washington, Oregon, Idaho and Montana, there have been nine fatal boating accidents since mid-March, with five occurring in Washington State. "There are three common factors in each one of these tragic accidents: cold water, no life jackets and small paddle crafts," said Dan Shipman, Recreational Boating Safety Specialist for the 13th Coast Guard District. "All accidents included water temperatures in the upper 30's, seven of the victims were not wearing lifejackets, and eight were operating small paddle crafts." Sudden immersion and exposure to cold water can quickly incapacitate a person who has unexpectedly ended up in the water. The sudden immersion in cold water makes it difficult, if not impossible, for boaters to keep their heads above water and stay afloat. Wearing a lifejacket gives boaters the best chance to survive. Snow melt and mountain runoff means spring waters in the Northwest will be cold and dangerous for the next several months. Boaters should make sure they have the required equipment - on board and in peak condition. "If you go out on the water this spring, make sure to check the weather, water conditions and never boat beyond your skill level and the capabilities of your vessel," said Shipman. Oregon and Washington states require all children 12 years old and younger to wear a properly fitting personal flotation device when boating in a boat that's underway. * Scout the condition of the lake, river or coastal waters before getting underway. * Be a competent swimmer. * Keep a sharp lookout for unexpected hazards. It's especially important this time of year when rivers run high and are full of debris. * Never use alcohol or drugs when boating or floating in a river. They dull important survival reflexes and impair decision-making skills. * Children should never boat or float a river without the close supervision of an adult. * Know and practice river rescue and self-rescue techniques. The fishing and water level forecasts are looking good. The Oregon State Marine Board wants to remind boaters about what they'll need to be safe and in compliance for the first outing this season. First, be sure to check your equipment. "Safety is paramount," says Ashley Massey, Public Information Officer for the Marine Board. "It's important to make sure your life jackets are in good condition (no mold, broken buckles, tears, etc.) and that there are enough to properly fit everyone on board. It's strongly recommended that adults wear a life jacket because even though the air temperature may be warming up, the water is always cold. In Oregon, 85-90 percent of boating fatality victims weren't wearing a life jacket and they wound up in the water due to capsizing or falling overboard. Water takes away body heat 25 times faster than air, so cold water immersion is a real threat to survival." Massey adds. "Also, be sure to have a fire extinguisher, a sound producing device, and visual distress signals. If you are going out to fish, be sure to have a good anchor with plenty of line. Another reminder is to ALWAYS anchor from the bow, not the stern, which can easily cause a boat to swamp and capsize." The Coast Guard Auxiliary, U.S. Power Squadrons and many law enforcement agencies conduct free vessel safety checks around the state and alert the boater if any safety equipment is needed. After an inspection, the boater is given a Vessel Safety Check sticker to affix to the boat. This sticker signifies that the boater is in compliance with all equipment requirements. Vessel safety check information is shared through the Marine Board's Facebook and Twitter pages (www.facebook.com/boatoregon and www.twitter.com/marineboard). Second, make sure your boat is in good shape before you get to the water. "Prepare ahead of time to ensure a stress-free excursion. We have links on our website to do-it-yourself instructions online, including engine maintenance and information on blended fuels," says Massey. "For the not-so-mechanically inclined, many marine centers and boat dealers can de-winterize your boat for you." The U.S. Coast Guard created a pre-underway checklist to help boaters prepare for their first outing at www.uscgauxnh.org/forms/PreUnderwayChecklist.pdf. Third, make sure your boat registration is current. "A second renewal reminder card was mailed to boaters at the end of March. For boaters who want to renew online, the renewal cards have a special identification number (PIN) that they can enter to access their registration information. Registering online is fast, simple and there's no online processing fee. Boaters can print a temporary permit after completing their transaction, so they can go boating right away," says Massey. "For folks new to boating or who didn't renew for a few years, you can contact the Marine Board and speak with a registration specialist who can help you or simply send in your payment to us," Massey adds. The cost for registering your boat is a flat, $3 per foot fee, rounded up, plus the $5 AIS fee. The fee for registering a motorboat has not changed in over nine years. Fourth, be sure to carry an aquatic invasive species prevention permit (AISP) if you're operating a paddlecraft 10 feet long and longer. Annual paper permits cost $7 through ODFW license agents, field offices and online at www.dfw.state.or.us. One year and two year Tyvek tags are also available from the Marine Board office in Salem for $5 and $10. These tags can also be ordered by downloading an online application and mailing/emailing it back to the Marine Board at www.boatoregon.com/OSMB/Clean/docs/2012AISPTyvekOrderForm.pdf. The decision follows re-opening the rules for Waldo Lake after seaplane pilots and motorboat proponents filed a lawsuit challenging the original ban in 2010. "The Marine Board reopened the rule to correct perceived procedural errors that could have resulted in the ban being overturned," said the agency's Director, Scott Brewen. "In doing so we addressed the key concerns including use of a rule advisory committee to consider economic impacts. During the public comment period we received 4500 written comments and 52 oral comments, with 92 percent in favor of maintaining the ban," added Brewen. One aspect of the original rule that was excluded by the Marine Board was the prohibition on seaplanes. Statute provides authority to the Marine Board to regulate seaplanes "on the water and not in flight," but also requires such actions to be "in cooperation with the State Aviation Board." The 2010 rulemaking process lacked a direct cooperative effort. Brewen met several times with the Aviation Board this time to fulfill that requirement. "We did sit down with members of the Aviation Board but could not find agreement to prohibit seaplane operation on Waldo Lake," said Brewen. "The Aviation Board's view of seaplanes as a mode of conveyance to Waldo Lake resulted in the inability of the two boards to arrive at a cooperative agreement to restrict or limit seaplanes. The concessions the Aviation Board was willing to make would not be enforceable under Marine Board statute, so those rules would need to be adopted by the Aviation Board. The Aviation Board has since voted to begin rulemaking regarding seaplane operation at Waldo Lake. We will work cooperatively with the Aviation Board, but the ball is currently in their court." The Marine Board approved the grant at its quarterly Board meeting on April 11, in Springfield. The Port of Newport's South Beach boat ramp is a popular destination for anglers and recreational boaters alike. The bay supports a salmon fishery of both coho and chinook as well as an abundance of bottom fish. The Hatfield Marine Science Center, the Aquarium and historic old town are just a few of the attractions in the area. The Port of Newport operates the South Beach boat ramp which is adjacent to a full service marina. The existing boarding floats were installed in 2005 but were constructed using untreated wood due to permit restrictions. Marine organisms and brackish water have corroded the untreated wood compromising the floats. To address the situation the Port is planning to remove and replace all of the floats with new ones made with material components not subject to the corrosive effect of brackish water and organisms that prey on wood. The refurbished floats will be re-installed and provide boaters with a safer and more secure platform from which they can load and unload their boats. The Port of Newport was awarded $91,906 in state boater funds, combined with $15,537 in applicant cash and $47,923 in force account labor and equipment from the Port. The Marine Board approved the grant at its quarterly Board meeting on April 11, in Springfield. Located in Umatilla County on the upper end of Lake Umatilla, the Port provides access to all types of boating on the Columbia River. The Port operates a public launch ramp as well as a marina with fuel. The existing marine sewage pumpout and dump stations, located on the fuel dock, have reached the end of their useful life. The proposed improvements will provide boaters with dependable equipment to dispose of boat waste. The Port of Umatilla was awarded $25,500 in federal Clean Vessel Act funds and $8,500 in state boater funds which will be combined with $3,000 in-kind contribution by the Port. The Board approved amended language for the Holgate Channel on the Willamette River, OAR 250-020-0280, to remove the exemption for commercial passenger vessels under 100 gross tons and clarifying the Board's current practice of exempting federal documented vessels from state title and numbering requirements. The final rule adoption pertains to OAR 250-010-0440, Boating Under the Influence of Intoxicants to include training in the operation of approved breath test equipment for individuals qualified under OAR 250-010-0440. The Oregon State Police or the Marine Board will provide a course of instruction as outlined in OAR 257-030-0160. A "turning over the keys" ceremony is taking place on April 26 at 1:30 pm at Power Yamaha, 333 SW Sublimity Blvd. Representatives from the Marine Board, Power Yamaha, Benton, Malheur and Yamhill Counties will be attending. Personal watercraft (PWC's), also known as wave runners or jet skis, enable law enforcement to quickly and efficiently help boaters in need and can access hard-to-get-to locations on area rivers. PWC's are shallow draft boats and with powerful motors. They can respond to emergencies faster than many other types of boats. PWC's are also more economical to operate and they use considerably less fuel. They also meet modern EPA emission [cid:image010.jpg at 01CD22C6.CADF4030] standards. Public safety agencies depend on PWC's for a wide variety of functions that include: * Towing stranded boats; * Pulling exhausted swimmers, surfers and sail boarders; * Search and rescue; * Accessing shallow lakes and rivers; * Removing hazardous debris; * Medical transport Benton County will receive two PWC's to patrol the Santiam and Willamette Rivers. Malheur County will use their two PWC's to patrol the Snake River and Owyhee Reservoir. Another pair of PWC's will be on stand-by in Yamhill County for use on both the Willamette and Yamhill Rivers and for specific patrol operations like the Rose Festival. This is the 24th year of the Personal Watercraft Industry Law Loan Program, supporting public and federal safety agencies with personal watercraft from Yamaha Motors Corporation USA and Kawasaki Motors Corporation USA. Since 1989, approximately 15,000 vessels have been loaned through manufacturers and local dealerships to law enforcement, fire and rescue, and marine mammal research organizations across the nation. The Oregon State Marine Board contracts with 32 Sheriff's Offices and Oregon State Police for marine patrol services. The Marine Board also supplies equipment and training for law enforcement agencies. In 2010, marine law enforcement saved 19 lives, with a great majority of those rescues on Oregon's rivers. Then you realize your boat decals are expired. Then you think, "Where did I put my boater education card?" Or if you're a paddler, "What did I do with my invasive species permit for the canoe?" Excitement about the weekend has now turned to dread, and its Friday afternoon. To make things easier, the Marine Board is extending office hours to 5:30 p.m. on Fridays beginning May 11 through July 6. The exception is May 25, which is a state furlough, so the office will be open until 6 p.m. on Thursday, May 24. Since the July 4th holiday is always popular for boating and all state offices are closed, the Marine Board office will stay open until 6 p.m. on Tuesday, July 3. "Meeting boaters' needs is a top priority," says Janess Eilers, Titling and Registration Manager for the Marine Board. "Compliance with rules and regulations is a must and it's our job to help educate and provide boaters information and quick service so they can enjoy their time out on the water." The Marine Board is funded by boat titling and registration fees, federal gas tax and other federal grants. The Embarcaderos Marina in Newport was certified on April 20th, and the Port of Hood River Marina was certified April 25. Both marinas meet the pollution prevention standards of the Oregon Clean Marina program and have voluntarily adopted measures to control environmental impact associated with marina operations. The "Clean Marina" designation is a testament to these marinas' efforts to do their part in keeping Oregon's waterways pollution-free. There are approximately 200 marinas, boatyards, yacht clubs, and floating home moorages that are all eligible for Clean Marina certification in Oregon. The first Clean Marina was certified in 2006, and with the certification of Schooner Creek Boatworks in December of last year, the number of certified facilities had grown to 51. "Last year we reached a milestone with 25 percent of Oregon's marinas certified in the program," says Rachel Bullene, Clean Marina Coordinator for the Marine Board. "There's another 23 who've pledged to work towards their certification, which says a lot about how much marinas care about the quality of our waterways and their customers who moor their boats at their facilities." The Oregon Clean Marina program is a voluntary program working to protect and improve local water quality by promoting the usage of environmentally sensitive practices at marinas. If a facility is in compliance with existing environmental regulations and uses a high percentage of the recommended best management practices, it can be designated as an Oregon Clean Marina. Such certified marinas are authorized to fly the Clean Marina flag and use the logo in their advertising. The flag and logo are signals to boaters that a marina cares about the quality of Oregon's waterways. Being a part of program has other benefits. The facility receives detailed information and tools to eliminate or reduce pollutants- such as oil, paint, cleaning chemicals, sewage, fish waste, and trash - from contaminating our waterways. WASHINGTON -Total boating fatalities last year rose to 758, the highest number on record since 1998, according to the U.S. Coast Guard's official 2011 Recreational Boating Statistics released today. >From 2010 to 2011, total reported accidents decreased less than one percent from 4,604 to 4,588, deaths increased 12.8 percent from 672 to 758 and injuries decreased 2.3 percent from 3,153 to 3,081. Property damage totaled approximately $52 million. The fatality rate measured 6.2 deaths per 100,000 registered recreational vessels, a 14.8 percent increase from last year's rate of 5.4 deaths per 100,000 registered recreational vessels. Operator inattention, improper lookout, operator inexperience, excessive speed and machinery failure ranked as the top five primary contributing factors in accidents. Alcohol use was the leading contributing factor in fatal boating accidents; it was listed as the leading factor in 16 percent of the deaths. Seventy percent of all fatal boating accident victims drowned, and of those, 84 percent were not reported as wearing a life jacket. Only 11 percent of deaths occurred on vessels where the operator had received boating safety instruction. In Oregon, there were 10 recreational boating fatalities in 2011. Eight of the fatalities occurred on rivers, one occurred in the ocean and the other on a lake. Three of those fatalities involved alcohol and seven of the victims were not wearing a life jacket. The boats involved in the fatalities included five paddlecraft, four open motorboats and one sailboat. "We're alarmed about the increasing number of deaths nationwide," said Capt. Paul Thomas, director of inspections & compliance." Thomas emphasized the importance of boating responsibly, citing the story of a family who lost two children while kayaking in Big Horn Lake in Wyoming last summer. After the weather picked up, the seven kayaks capsized and the party became separated. Boaters should always check the weather forecast prior to launching and remain watchful of changing conditions. The Coast Guard and Oregon State Marine Board remind all boaters to boat responsibly while in or around the water: wear a life jacket, take a boating safety course, get a free vessel safety check and avoid alcohol consumption. The first hazard is located above Shady Cove, another above the Twin Bridges and the last, between TouVelle and Bear Creek. The Marine Patrol wants boaters who operate kayaks, canoes or inflatable craft -including inner tubes, to avoid these stretches along the Rogue River. "The most dangerous is the one above Shady Cove," says Deputy Jason Denton, Marine Patrol Deputy for Jackson County. "This is a large, 160-foot long fir tree with at least a six foot root wad. Several boaters have already been swept into the hazard which was witnessed by a local homeowner. The current takes less maneuverable boats right into it," Denton says. The marine patrol is hiring a local contractor to mitigate this hazard before the weekend. Both of the navigation hazards above Twin Bridges and between TouVelle and Bear Creek are trees that have fallen into the river from the bank, but in areas where the river is wide enough to safely navigate through. The report comes just weeks before marine law enforcement officers nationwide turn out for Operation Dry Water (ODW), an annual campaign focused on enforcement of BUI laws and educating all boaters about the risks of operating a boat under the influence of alcohol and/or drugs. Operation Dry Water 2012 will be held June 22-24, just prior to the Fourth of July. Those caught operating a vessel under the influence will find their voyage terminated and their vessel impounded. Penalties may also include arrest, fines up to $6,250 and loss of boating privileges for up to three years in Oregon. Despite the fact that it is against federal law and Oregon law for a person with a blood alcohol concentration (BAC) of .08 or higher to operate a boat, BUI continues to be a major problem in the U.S. and accounts for a disproportional number of deaths on the water. Alcohol was a contributing factor in just 6 percent of boating accidents overall, but figured in 16 percent of boating fatalities in 2011. Operation Dry Water, a multi-agency, education and enforcement initiative launched by the National Association of State Boating Law Administrators (NASBLA) in 2009 in partnership with the U.S. Coast Guard, puts thousands of local, state and federal marine law enforcement officers on the water just before the Fourth of July to give BUI enforcement high visibility before a holiday known for drinking and boating - and deadly accidents. "There are huge risks if drinking and boating," says John Fetterman, law enforcement director for NASBLA and national spokesperson for Operation Dry Water. "These are needless deaths in a recreational activity that is safe and enjoyable when people stay alert and follow the rules." The Board approved a boating facilities grant for the Port of Brookings' Sports Harbor that sustained damaged from the March 2011 tsunami. Three major tidal surges destroyed nearly 30% of the Sports Basin, including "A" dock, which was completely displaced. The surge also deposited sediment in the basin making mooring a boat with a draft nearly impossible. The Board authorized $51,875 in state boater funds, combined with $4,500 of in-kind contributions, $104,500 in federal Clean Vessel Act funds, and $61,125 in federal Boating Infrastructure Grant funds for a project total of $222,000. This grant will allow for harbor dredging, dock repair and will replace the pumpout/dump station. The Board directed staff to move forward with the 2013-2015 proposed budget and approved two legislative concepts affecting the Ocean Charter Vessel and the Abandoned/Derelict Vessel programs. Additionally, the Board elected a new Chairperson. Chair George Tinker's (Coos Bay) term is concluding and the new Chair is Rick Allen (Madras) and Vice-Chair, Brian Carroll (Albany). Marine law enforcement personnel from around the state will be training on the river at Gold Beach from September 9-13. The training focuses on honing boat operating skills from safe trailering to controlled spins and emergency stops. "We are advising boaters in the area to stay clear for safety sake," says Dale Flowers, Law Enforcement Training Coordinator for the Marine Board. "We're hoping to have a minimal impact on recreation, but boaters need to be aware that the performance objectives will require extreme focus by the students -the wider the berth, the better." Students who attend the Marine Board's Whitewater Jet Boat Training bring a range of skills from the novice operator to advanced operator. "One of the goals of the training is to pair up an experienced marine deputy with a new jet boat operator. It turns out to be a tremendous learning opportunity for everyone who participates," Flowers adds. Signs will be posted at local access sites about the training operations and notices have also been sent to all the registered fishing guides in the area. In addition to boat handling exercises in whitewater conditions, marine deputies will also learn how to disassemble, service and reassemble jet pumps, learn anchoring and chocking techniques, and how to navigate all stages of whitewater rapids. "The training is necessary to ensure that help is there when boaters need it," Flowers says. The Marine Board contracts with 32 Sheriff's Offices and the Oregon State Police for services including enforcing boating laws, search and rescue operations, and boating safety education. The Cleetwood Cove boat facility is operated by Xanterra Parks and Resorts, and is the launch point for tour boat operations on the lake. While not a traditional recreational boating facility, the marina does perform the same types of activities, such as fueling and boat maintenance that could impact water quality. The Cleetwood Cove facility has voluntarily adopted measures to control environmental impact associated with their marina operations. The "Clean Marina" designation is a testament to this facility's efforts to keep one of Oregon's most pristine lakes pollution-free. "Xanterra and National Park Service staff deserves congratulations for all the effort they've taken to protect the water quality of the lake," says Rachel Bullene, Clean Marina Coordinator for the Marine Board. "I was able to immediately certify this facility during the initial evaluation because of how well they operate." The Oregon Clean Marina program is a voluntary program working to protect and improve local water quality by promoting the usage of environmentally sensitive practices at marinas. If a facility is in compliance with existing environmental regulations and uses a high percentage of the recommended best management practices, it can be designated as an Oregon Clean Marina. Such certified marinas are authorized to fly the Clean Marina flag and use the logo in their advertising. The flag and logo are signals to boaters that a marina cares about the quality of Oregon's waterways. Being a part of program has other benefits. The facility receives detailed information and tools to help prevent pollutants- such as oil, paint, cleaning chemicals, sewage, fish waste, and trash - from contaminating our waterways. There are approximately 200 marinas, boatyards, yacht clubs, and floating home moorages that are eligible for Clean Marina certification in Oregon. The first Clean Marina was certified in 2006. Here's a list to make winterizing your boat more efficient: Your Boat 1. If possible, store your boat ashore for the winter. The bulkhead, keel and motor are the critical areas needing support. Cradles work best, but don't store your boat on a cradle that wasn't designed for the boat you have. 2. If you store your boat in the water, make sure to close all through-hull fittings, gate valves and seacocks to keep the water out. As water freezes, it expands and can break these important features. Also, plug any exhaust ports. Do not, however, close cockpit drains. Check on your boat occasionally to make sure lines are secure and the bilge remains dry. 3. Make sure to cover your boat. Use a frame under the cover to prevent water from pooling or tearing the cover. Canvas is best because it breathes. If you use plastic, make sure you leave vents in it to allow any moisture to escape. Allow for drainage if you're storing outside. 4. Add non-toxic antifreeze to water tanks, toilets and septic holding tanks. Never use engine antifreeze in a freshwater system. 5. Make sure to remove any electronic equipment, important documents or other valuables. Marinas are more like ghost yards in the winter, and tempting to thieves. Your Engine * Drain the cooling system and add anti-freeze. On outboards, this means filling a large bucket or drum with enough antifreeze fluid to reach the water intake, then running the motor until it is warm. Use non-toxic antifreeze only. * Disconnect the battery and store in a warm, dry place. If you have to leave it on board to operate an alarm or bilge pump, fill battery cells with distilled water and fully charge it so it doesn't freeze. Apply petroleum jelly to clean terminals to prevent corrosion. * Oil: Drain and replace the engine, transmission and outdrive oil. Replace gear oil in outdrives. Use internal oil fogger when the engine is warm to prevent corrosion. Many boat dealers have service centers that can help with the messy fluids and recycling for a reasonable price. * Top off fuel tanks, leaving a little room for expansion. Add a fuel stabilizer, especially if you run gasoline with ethanol blended in. What's better? Not using blended fuel. There are several months left in the year and so far Oregon has had 17 recreational boating fatalities. The fatalities have involved all forms of watercraft, from Stand Up Paddle Boards (SUPs) to a sailboat and everything in between, including three inner-tubes tied together. "Recreational boater deaths are particularly tragic because they occur while people are out on the water to enjoy themselves with family and [cid:image004.jpg at 01CDAC83.00DAE090] friends," says Scott Brewen, Director of the Marine Board. "What's more tragic is that most are preventable." As with other years, most fatalities can be attributed to capsizing and falls overboard. Victims not wearing life jackets or consuming alcohol, contributed to the accidents. Falls-overboard may lead to drowning when the body does an involuntary "gasp reflex" when entering frigid water. If a person isn't wearing a life jacket, it's easy to inhale water upon initial immersion. "In 2012, prop strikes claimed the lives of two victims," says Ashley Massey, Public Information Officer for the Marine Board. Massey also adds, "We've seen a steady decline in motorboat accidents and fatalities since mandatory boater education requirements phased in. Interestingly, 7 of the 9 motorboat fatalities hadn't met their boater education requirement. Seven of the fatalities involved non-motorized craft where there are no education or registration requirements. With the fatalities this year, only one of the motorboat victims wore a life jacket and only two of them took a boating safety course. But even with education, boaters need to practice what they're being taught." It's also important to recognize that inflatable boats, kayaks, canoes, and float toys are unstable. River currents can lead less maneuverable craft, like inflatable rafts, directly into an obstruction. Massey points out, "It's important to use a watercraft in the way it was designed. A pool toy isn't designed for use in a river." Marine Patrols across the state report shredded pool toys littering popular rivers. Marine patrol action reports received by the Marine Board reflect numerous close calls and rescues this spring and summer. "We know from monitoring newspapers articles that there were a lot of close calls on the Rogue, Umpqua, McKenzie, Willamette and North Santiam Rivers and fortunately, the boaters were able to self-rescue," Massey adds. "By combining what's been reported by the marine patrols and from the newspapers, we're probably pretty fortunate that the fatality numbers aren't any higher." The Marine Board offers the following tips for boating in the fall and winter: * Always wear a properly fitting life jacket. Wear it over the top of other insulated clothing. The water temperature is cold and a life jacket will reduce risk from muscle cramping. * Always boat (or float) with other people. Stay with your party and discuss what you'll do if you become separated. Have a float plan so family and friends know where you are going and when you expect to return. A float plan can be downloaded at http://www.oregon.gov/OSMB/library/docs/FloatPlan.pdf. * Have important items like a cell phone and car keys in a water-tight container or bag. * Know the river. Rivers are in a constant state of flux, depending on dam releases and weather conditions. Novices should avoid whitewater or should go with an experienced rafter or outfitter/guide. Check the Marine Board website for reported waterway obstructions. * Know your launch and take out point. If there's a sharp bend in the river, bank your boat and scout ahead. Local river guides can offer extremely helpful advice on areas to avoid and the best channels to take. * If you wind up in the water, float with the current with your feet first, downstream. Use your arms like oars and steer toward the bank. Do not fight the current. Try and relax and float on your back. This is much easier when wearing a life jacket. "We want people to have fun, but boat safe, boat sober and always wear a life jacket," says Massey. The Marine Board is mailing approximately 82,055 notices on November 1. "Renewing online is quick and easy and there's zero processing fee," said Ashley Massey, Public Affairs Specialist for the Marine Board. Each renewal notice has the boat owner's registration number (OR number) and a PIN. "The boat owner goes to the Marine Board website at www.boatoregon.com, clicks on the registration decal image or "click here to renew online" link, and enters the information from the renewal notice into designated fields." The online system is secure and the Marine Board does not retain any credit card data. Boaters who let their registration lapse last season (decals that expired 12/31/11) can still renew online. The boat owner just needs to call the Marine Board to receive a PIN over the phone at 503-378-8587. "Another advantage to renewing online is that boaters can print out a temporary permit right away, and immediately get out on the water," said Massey. Decals are mailed within 5-7 business days. "The electronic process provides a great turnaround-time for boaters, and it's much more cost-effective for the agency." The notices include the $5 surcharge for the Aquatic Invasive Species Prevention Program that was passed by the 2009 legislature. The fee is an additional charge to the boat registration, which has not increased. Registration fees are $3 per foot, rounded up, based on the length of the vessel. Boaters can also renew their registrations at the Marine Board Office in Salem, by mail or through 83 registration agents statewide. This new, 22-foot aluminum River Wild (Liquid Technologies) boat and trailer that comes equipped with a 6.0 L fuel injected engine that produces low carbon emissions and is more fuel efficient than boats built prior to 2006. The jet propulsion is capable of being operated in a variety of conditions including water depth as little as six inches, on a full plane, with a carrying capacity of 1200 pounds. This boat is ideal for varying weather conditions along the Columbia River and nearby waterways and will allow marine deputies to respond to emergency situations quickly. The Sheriff?s Office currently has five trained deputies for marine patrol operations. Morrow County Sheriff?s Office previously owned and operated a 1993 Almar inboard boat that required frequent maintenance after 19 years of use. The new patrol boat was built in Grants Pass, Oregon, and was purchased by the Marine Board for $44,850 after a trade in from the Almar. ?This boat can go in any kind of water,? says Mervin Hee, Waterways Coordinator for the Marine Board. ?Because it?s built with the most modern technology, this boat will be much more cost-effective to operate with very little maintenance and huge gasoline savings. This boat will serve the boaters of Morrow County for decades.? The Marine Board is funded by registration fees and marine fuel taxes paid by boaters. But there's more to it than just trying out the activity and deciding to buy a paddlecraft. Each year thousands of people flock to the waterways with little knowledge about their boat, where they're operating, what the legal requirements are, and the skill needed to avoid an accident. The Oregon State Marine Board now offers a great introduction to the waterways with a free online paddling course, approved by the National Association of State Boating Law Administrators. The Online Paddling Course, offered through BoaterExam.com, covers state boating laws, rules of the road, how to read the waterway, what to do in case of an emergency, and other tips to enhance boater's knowledge base and operating skills. "There are so many boating opportunities in Oregon on all kinds of waterways. We're so fortunate to have great public access to rivers, lakes, bays and the ocean," says MariAnn Koloszar, Boating Education Coordinator for the Marine Board. "Paddling comes in a lot of different forms. There's a huge interest for people to connect with nature and stay fit at the same time. Learning how to paddle is a great way to get your feet wet in recreational boating." In 1999, the Legislature approved the mandatory boater education law requiring operators of motorized boats over 10 horse power to take an approved boating safety course and carry a boater education card when operating their boat. This program was phased in based on the boat operator's age and in 2009, all boaters were required to carry their card. The Marine Board has issued nearly 300,000 boater education cards since 2001 and has seen a decline in reported boating accidents. "Education had a direct impact on making the waterways safer. When everyone knows how their own watercraft handles, know the rules of the road, as well as being prepared for emergency situations, everyone wins," Koloszar adds. "Everyone can co-mingle safely and enjoy Oregon's beautiful waterways." Ms. Early was confirmed by the Senate on September 12 and recently attended her first Board meeting in Maupin on October 23. Board member Early's love for the waterways happened at a young age. While sitting on the front steps of the family farm home, she witnessed her father helping rescue neighbors to higher ground by using his tractor to tow whatever belongings he could salvage. This event would later become known as the "Great '64 Flood," where many rivers became mini-oceans, engulfing everything in their path. This situation instilled her lifelong respect and fascination with waterways. Early's father, Cal Wade, held a seat on the Marine Board in the 1970's, and through his service, she was exposed to boating issues in Oregon, while becoming proficient in operating drift boats and other watercraft on the Rogue River. Early holds a U.S. Coast Guard Uninspected Passenger Vessel License. She also is an owner/operator of Early Fishing, Inc., a fishing guide service that is registered to operate in Oregon, California and Alaska. In addition to Early's boating experience she has volunteered with many organizations on river conservation and habitat including the ODFW Fall Chinook Conservation Plan, USFS National Center for Wild and Scenic River Excellence Working Group, Chetco Watershed Council, Brookings Harbor Safe-N-Sober, and other outdoor events that promote fishing, conservation and safety. The obstruction is located river right heading downstream. A gravel bar enters into where a large tree with root wad have fallen, making it a dangerous, hard-to-avoid strainer, capable of trapping boats with the swift current and shallow corner. This area is frequented by drift boat and raft anglers. The Marine Patrol report that portage is possible on the adjacent public land, but portage may not be an option for some types of paddlecraft. Signs are currently being made. Marine deputies will be posting warning signs upstream of the strainer and remind all boaters to wear a properly fitting life jacket. The next accessible boat ramp to access the Chetco River is Social Security Bar, located several miles downstream. The Marine Board's conference was held in conjunction with the Oregon State Sheriff's Association's annual conference in an effort to minimize costs and maximize the time for law enforcement personnel. Three categories of awards were presented this year: Officer of the Year, Outstanding Achievement, and Life Saving. Marine Director Scott Brewen presented the awards, along with law enforcement program managers or the local Sheriff of the award recipient. The Officer of the Year award was presented to Deputy Nate Thompson from the Clackamas County Sheriff's Office. This award represents performance above and beyond the call of duty. This award is for a marine officer who has distinguished themselves by exceptional service to the Marine Program. "Deputy Thompson exemplifies everything a Marine Officer should be," said Marty Law, Boating Safety Manager for the Marine Board. "Deputy Thompson can always be counted on, makes thousands of boat contacts a year and also teaches boating safety to local Clackamas County schools. His knowledge of boating and operation skills is a huge asset to the county and to the Marine Board. Nate has become one of the core instructors for the Marine Academy and jet boat operator's course for marine law enforcement and has helped develop a personal watercraft course for implementation in 2013. He is also a trained, Swift Water Rescue AND Rope Rescue Technician and has come to the aid of the Clackamas County Fire District #1 and other sheriff's office units for local search and rescue operations." Law added, "Nate also has a very strong mechanical aptitude and is relied upon by his department and other neighboring agencies to keep their boats on the water." Additionally, Deputy Thompson participated in a boating safety video for the Marine Board about boating under the influence of alcohol, conflict, congestion and courtesy, and wearing personal flotation devices and during the taping, never skipped a beat and would stop taping to interact with floaters entering the water from the boat ramp to make sure they weren't carrying any alcohol and had the proper equipment. Deputy Thompson is very articulate and knows how to communicate well with the boating public, ultimately helping keep the waterways safer for everyone to enjoy. There were two recipients for the Outstanding Achievement award: Jason Denton from the Jackson County Sheriff's Office and Lt. Dustin Hald from the Columbia County Sheriff's Office. This award recognizes excellence in performing all areas of marine patrol: enforcement, public education, partnerships and administering the program in such a way that enhance the quality of safety, service and outreach. Jackson County's Deputy Jason Denton exemplifies outstanding achievement. During the 2012 boating season, Denton single-handedly made 1298 boater contacts and made 23 BUII arrests from July 1 to present. Denton leads the way in BUII detection in the state and has been an integral component to safer waterways in Jackson County. Denton is also a talented instructor and helps the Marine Board's law enforcement training program by teaching new marine law enforcement personnel for the Marine Academy, drift boat and white water jet boat schools held this year. The other Outstanding Achievement award was presented to Columbia County's Lt. Dustin Hald. The Sheriff's Office faced extreme financial instability in 2012 and even with a tremendous list of responsibilities, including supervising the entire enforcement division, office staff, reserves and marine patrol; he dove right in and made much needed repairs to the boats using his own personal time. Lt. Hald enlisted the help of other members of the Sheriff's Office to help achieve program goals and managed to spend one to two full shifts per week of active water patrol that increased the number of boater contacts and on-the-water contract hours. During his time on patrol, Lt. Hald stopped three individuals for BUII, which inspired other marine deputies to work harder in BUII detection and enforcement. "Lt. Hald is doing as a leader should -leading from the front," said Marine Deputy Dustin King, who submitted the nomination for Outstanding Achievement to the Marine Board. Thanks to the efforts of marine law enforcement from Benton, Curry, Deshutes, Malheur and Wallowa counties, 16 lives were saved; Fifteen human and one canine. The Life Saving Award recognizes personnel who have exhibited heroism in saving, or attempting to save, a person involved in a dangerous or live-threatening water-related incident. * On Sunday, September 4, 2011, at about 5:30pm, Benton County Marine Deputies Kyle Cooper and Adam Brenneman were patrolling the Willamette River on personal watercraft near the Crystal Lake Boat Ramp near Corvallis. They saw a group of teenage girls on rafts and inner tubes struggling in the middle of the river. An adult male in a kayak was waving the deputies over to the girls. As the deputies got nearer, they recognized the group from several hours before when the deputies contacted them near the Peoria Boat Ramp. The group of four girls had tied one small raft and two inner tubes together while floating the river. The deputies reminded them about the dangers of being tied together. The male in the kayak was one of the girl's fathers. Everyone had a personal floatation device, but none were wearing one. The group untied their rafts. When Deputies Cooper and Brenneman got closer to the group, they saw the crafts were entangled around a log. Deputy Brenneman noticed one of the girls was caught by her leg in the ropes under the water. She was unable to stand or keep her head above water. Deputy Cooper maneuvered his personal watercraft close and cut the rope that was holding the girl under water. The rope unwrapped and freed the girls from the log. The group all climbed onto their raft and hung onto Deputy Cooper's personal watercraft until Deputy Konzelman arrived with a patrol boat and transported them to the Crystal Lake Boat ramp. No one received any injuries due to the quick action by Deputy Cooper and Deputy Brenneman. * On Monday, September 5, 2011, at about 4:08 pm, Marine Deputies Kyle Cooper and Adam Brenneman were patrolling the Willamette River in a patrol boat, near the Van Buren Street Bridge near Corvallis. They saw a young male swimming in the middle of the river, with no personal flotation device. As they got closer, they watched as he went under the water several times. They immediately threw him a life ring and brought him on board and transported him to Michael's Landing. The seventeen year old boy said he was trying to swim from the Mary's River to Michael's Landing, a distance of about a mile and a half. He became tired about half way down, and experienced muscle fatigue, combined with cold water and could no longer keep his head above water. * On September 2nd, 2011 at about 2:30pm, The Curry County Sheriff's Office was notified of a capsized boat in Blossom Bar Rapids on the Rogue River with a possible drowning involved. Marine Deputy Ted Heath responded to the area by towing his patrol boat thirty-four miles upriver to launch at Foster Bar boat ramp. Deputy Heath was advised by Curry County Sheriff John Bishop that he would meet Heath at the boat ramp and assist in the rescue. Sheriff Bishop arrived at Foster Bar awaiting Deputy Heath's arrival when he noticed a swimmer that appeared to be in distress in the middle of the river. The swimmer started to go under water. Sheriff Bishop summoned a nearby boater, Robert Bumguardner and his wife Judith, who were able to use their jet boat to push the swimmer closer to the Sheriff who at this point, had jumped in the water to get to the swimmer. The swimmer was too exhausted to grab the side of Bumgardner's boat and was assisted to shore by Sheriff Bishop. Deputy Heath arrived at the boat ramp and saw the unidentified swimmer sitting at the water's edge. The swimmer was extremely exhausted and too weak to stand up but, refused medical assistance. It was later determined that the swimmer had entered the river about a mile and a half upstream, in an attempt to get to his camp site, when he was caught up in current. The swimmer had drifted through the treacherous rapids of Foster Bar before being rescued by the Sheriff, which was miraculous, in and of itself. Sheriff Bishop and Deputy Heath then resumed their response for the original call -a capsized boat and missing person, which they were able to locate. Unfortunately, this person did not survive. His body was recovered a few days later. * On May 20, 2012, Deschutes County Deputies Eric Brown and Tom Teaford finished trailering their patrol boat at the North Wickiup boat ramp. Deputy Brown observed a boat capsizing approximately 30 feet from the end of the dock and several people were struggling in the water near the boat. Deputy Brown could see the people were in serious trouble so he quickly located a flotation device and ran to the end of the dock. In the water were three adults and two small children. None of the adults was wearing a life jacket. Deputy Brown threw the flotation device toward the adults, but a strong cross wind made the device fall short of the victims. Deputy Brown removed his utility belt, preparing to enter the water and simultaneously made contact with his partner, Deputy Tom Teaford. Deputy Teaford had a rescue rope and successfully deployed it to Rebecca Steele, who was approximately 15 feet from the dock, holding her 15-month old son, James in the water that was approximately 15 feet deep. Deputy Teaford and Brown were able to pull Rebecca and James to the dock. Rebecca was instructed to hold onto the dock as Deputy Brown removed the infant from the water. Deputy Teaford assisted Rebecca out of the water while Deputy Brown re-deployed the throw rope to 74 year old, Joel Wade, who was holding onto the bow of the capsized boat. Two off-duty Deschutes County Search and Rescue Volunteers, Molly McCallum and Roger Allen were nearby in their personal boat and threw a life jacket to Joel Wade. Deputy Brown and Teaford were able to pull Wade to the dock. A second child, five year old Dana Goddard, was being held by Delores Steele. SAR Volunteers McCallum and Allen maneuvered their boat to a position that enabled them to safely pull Dana onto their boat. Deputy Brown, then deployed the throw rope to Steele and pulled her to the dock where she was then able to walk up the ramp, unaided. Due to a physical limitation, Joel Wade was unable to pull himself onto the dock and Deputies were unable to remove him from the water. Deputies Brown and Teaford were able to grab ahold of him and alongside the ramp, however; due to the water temperature and exhaustion, Wade was struggling to maintain his grip on the dock. The Deputies were also concerned they would lose their grip on him. Deputy Brown was able to rig the throw rope around Wade's back and arms which held him partially out of the water. Deputy Brown assisted Wade far enough up the ramp to where other deputies could assist him onto the dock. Water temperatures at the time were just over 50 degrees. It's clear that as a result of the quick thinking and decisive action on the part of Deputies Brown and Teaford, as well as the SAR Volunteers McCallum and Allen, five lives were saved that day. * On June 2, 2012, Payette County Idaho Deputies Patrick Weber, Steve Burgess and Malheur County Sr. Deputy Anthony Hackman responded in Payette County to a boat crash located upriver from the Ontario boat ramp. Two individuals identified as Vimal Vagha and Eric Wilber were standing on a sunken boat in medium current near the train trestle that crosses the river and one subject was standing on a sand bar approximately 10 yards from the other individuals. The deputies positioned their boat in the current below the two subjects, who were not wearing life jackets. Mr. Vagha had severe facial trauma; his eyes were swollen shut and a large amount of blood was coming from lacerations on his right cheek and nose. This gentleman was having difficulty breathing, was hypothermic and quickly going into shock. Mr. Wilber, who was standing next to Mr. Vagha was wearing a white shirt covered with blood. Mr. Wilber turned gray and could not communicate indicating he too, was hypothermic and in shock. Deputy Weber held the bow of the patrol boat near where the two men were standing. Deputy Burgess placed a life jacket on Mr. Vagha and lifted him into the patrol boat. Mr. Vagha immediately collapsed. Deputy Hackman advised Mr. Wilber that they were going to lift him next to the boat but was deteriorating quickly. Unable to communicated and appearing confused, Deputies Burgess and Hackman each grabbed an arm and attempted to lift him into the boat, unsuccessfully. Deputy Weber then drove the patrol boat to the sandbar with both deputies holding onto Mr. Wilber. The driver of the crashed boat, Mr. Manning, was able to assist the deputies in getting Mr. Wilber into the boat. Mr. Wilber sat in the tripod position on the bow and also appeared to have difficulty breathing. As soon as the men were all in the boat, they were immediately transported to the Ontario boat ramp where Treasure Valley paramedics were waiting. At the boat ramp, Mr. Vagha and Mr. Wilber were back-boarded and placed into the ambulances. Mr. Wilber crashed immediately and the paramedics had to place a large needle into Mr. Wilber's chest to re-inflate his collapsed lung. Mr. Wilber was transported code 3 to the hospital. The driver of the boat was charged with boating under the influence of intoxicants and reckless endangering. Both victims fortunately made full recoveries. The paramedics reported that the cold water and quick response helped save the lives of these to victims. * On August 19, 2012 Deputy Lawrence McBurney was patrolling the south end of Wallowa Lake when the wind suddenly picked up. Deputy McBurney decided to check on boaters to see if anyone needed assistance. After helping a distressed kayaker return to shore, Deputy McBurney saw another boat toward the center of the lake. Within minutes the wind was gusting around 50 miles an hour and the waves were cresting upward 6 to 7 feet. Progress to the boat was slow and rough with nearly zero visibility and waves breaking over the bow of the patrol boat. Upon arrival to the open 16-foot motorboat, there were four occupants and a large, yellow lab. The only person wearing a life jacket was a small child, Evan Porter, age 6. A female, Amy Porter who was pregnant, was furiously bailing water from the boat. A man, Brent Hergert was at the tiller of the 6 hp motor and driving into the waves in an attempt to keep the boat from swamping. Another woman, Debra Hergert, was at the bow of the boat and had been suffering from a variety of physical ailments, which would later prove challenging. The boat was being violently slammed with each set of waves, making it impossible to contact the vessel safely from the side. While positioning the boat from near the bow, Deputy McBurney tried to tell the occupants to don life jackets, but the wave and wind action were too loud for them to hear his commands. It was difficult to maneuver the boat because the waves and wind continually pushed the boats apart. After multiple attempts to communicate with the occupants, a series of waves trampled the small boat, capsizing it and ejecting all of the occupants. Everyone except for Mrs. Hergert was able to swim. Mrs. Hergert was able to grab a child's life jacket in her left hand. She was near the boat, which was taken up by a wave, and then violently slammed down, onto her head. Deputy McBurney dropped his utility belt onto the floor of the patrol boat and tossed out a throw rope and a Type IV float cushion, neither caught by the occupants. McBurney was close enough to Mrs. Hergert to the swim platform but she was unable to hold onto the boat. While holding Mrs. Hergert, McBurney managed to throw the rope with the float cushion out to Mr. Hergert, but again, the wind caught the device and it fell short. Then, Mr. Hergert's dog swam over to the flotation device, retrieved it, and swam directly to Mr. Hergert. The dog stayed with Mr. Hergert while McBurney tried to help Mrs. Hergert into the boat. Ms. Porter was able to swim to the boat with her son, who was being helped by the wind and timed a wave to where she lifted the boy to McBurney who ran the boy to the bow and put him into the operator's chair of the patrol boat. Ms. Porter was pulled onboard immediately helped pull Mrs. Hergert onto the swim platform. Moments before, Mrs. Hergert was about to give up. She repeatedly was pushed under the transom of the boat. At one point, McBurney lost grip of her and was forced to pull her from her hair. After several attempts and maneuvering, McBurney and Ms. Porter finally managed to pull Mrs. Hergert into the boat. Then McBurney maneuvered the boat to Mr. Hergert and his faithful dog that had drifted nearly 200 feet away. Both were retrieved successfully, and Mr. Hergert requested the dog be rescued first. Once everyone was on board the patrol boat, McBurney instructed all of them to don life jackets and contacted dispatch for an ambulance. It took a while to make progress back to the boat ramp, but once there, all of the victims were checked out by medics but refused hospital care. A few days later, Deputy McBurney contacted Mr. Hergert to follow up and learned that x-rays indicated Mrs. Hergert suffered from bruised lungs and internal bruising. Fortunately, all four victims and their dog survived their outing on Wallowa Lake that day. Wallowa County Sheriff Fred Steen said, "He did an awesome job by himself, controlling the patrol boat and retrieving all of them from the rough water."
