Marine Board Adopts Rules, Other Items

The Oregon State Marine Board adopted divisional rules and approved initiating rulemaking on four other rules during their quarterly Board meeting, held in La Pine on October 5.  The Board also denied a grant request for the South Wasco Parks and Recreation District.  Additionally, the Board directed staff to submit a report with recommendations for potential statewide rulemaking on wake sports.

The Board adopted rules for Division 015 and 016, Ocean Charter Vessels and Motorized Outfitter/Guide Registration.  The rules become effective January 1, 2018.  These rules are a result of the passage of HB 2039 in 2013, to improve training and safety requirements for Outfitters, Guides and their employees.

Additionally, the Board approved initiating the rulemaking process for the following items:

*       Visual Distress Signals, OAR 250-010-0164: Changing the deadline where visual distress signals are required on the Columbia River to be consistent with Federal law;

*       Hunt Tag Program Fees, OAR 250-016-0040: Return the fee to the prior fee schedule in accordance with ORS 291.055;

*       Aquatic Invasive Species Permit Program, OAR 250-010-0650: Boats owned by liveries or guides who purchase a discount certificate for six or more non-motorized boats are exempt from the permit carriage requirement;

*       Fees for furnishing Information, OAR 250-001-0020: Amend rule to comply with standardized state fee structure for public record requests.

The Board reviewed the work by the Wake Enhancing Device Stakeholder Group for rulemaking for boat operations in Yamhill and Marion Counties, OAR 250-020-0385, with respect to the wake enhancing devices deadline.  The Board did not open rulemaking, leaving the existing rule in place.  Instead, the Board directed staff to study the activity of wake sports from a statewide perspective and submit a report with recommendations at the January Board meeting.

The Board also denied a grant to the South Wasco Parks and Recreation District to replace the North boat ramp on Pine Hollow Reservoir; however, directed staff to continue working with the Oregon Department of Fish and Wildlife and Parks District to explore other options and funding partnerships to keep recreational boating access open.

In other agency matters, the Board appointed Policy and Environmental Manager, Rachel Graham as the interim Marine Board Director while conducting a search for a new agency head.
