Look on your agency report screen, Quarterly and Yearly Run reports menu, for a list of uploaded activity. You'll see two series of CFD reports. See attached. PEBB states, "Your payroll will add the value of this coverage...". OSPS will add the amounts given to us by PEBB to the affected employee's Oregon taxable income. This will be on the employee's W-2. Agency payroll does not need to do anything for this to happen. At the moment we do not have a finalized listing from PEBB sorted by agency. A list will be provided to agency payroll whether that comes to you through the PEBB.Benefits system or from OSPS. Please be aware that the Department of Revenue has a "reconnect bill" for Legislative action during the 2011 session that, if passed, would eliminate the taxability of the insurance coverage retroactive to 2010 and going forward. Should the Legislature reconnect the Oregon tax law to the federal law, OSPS will issue corrected W-2s to reduce the Oregon taxable income previously reported. Affected employees may wish to delay filing their 2010 Oregon income tax return until this has been resolved. OSPS Leave Report B470 will identify these records with the message "Review LA Obligation". This alert will continue through pay period June 30, 2011. This considers the number of months left to take all furlough obligation and calls attention to any employee who may not be taking furlough days as originally planned. A balance of 56 or more hours may mean that the employee will have to take more than 8 hours in a month to remain on track. This is a condition that should be reviewed by agency management to ensure that no employee fails to satisfy their furlough obligation by 6/30/2011. That message is pasted in below. We have now received updated instructions from the Department of Revenue about how to report these amounts on Form W-2. We will post the imputed value amount in Box 14 with a label "ACA Child". At the time W-2s are issued, we will provide you with an informational message to give to affected employees. PEBB is sending a report to each affected agency with a listing of all employees for whom an imputed value will be reported. This topic is on the agenda for this afternoon's OSPS Payroll Forum. Message From DOR - Dated 12/16/2010 Affordable Care Act: As a result of changes made by the recently enacted Affordable Care Act, health coverage provided for an employee's child under 27 years of age is now generally tax-free to the employee for federal purposes, effective March 30, 2010. Previous law allowed such treatment for dependents under 19 years of age, or under 24 if the dependent was a student,. Oregon has not adopted these changes. As a result, any expanded coverage provided for adult children under the Affordable Care Act is taxable income to the employee receiving the benefit for Oregon purposes. The legislature may act to adopt this exclusion in the 2011 session, but at this time it cannot be predicted with any certainty that such action will occur. The department recommends that employers take the necessary steps to include these amounts on the affected employee's W-2 statement for tax year 2010. Please report this amount in Box 14 and label this amount "ACA Child." Do not modify the state wages in Box 16. This will allow taxpayers to easily identify the appropriate amount of income to report if the legislature does eventually decide to exclude these amounts from Oregon taxable income. We will post further updates and instructions to taxpayers on our website in January. Subsequently, we met individually with several agencies to discuss the intricacies of and provide clarification on donated hardship leave administration. As a result, a toolkit link was added to State HR Policy 60.025.01 Donated Leave. The toolkit may be found at: http://www.oregon.gov/DAS/HR/rules.shtml The toolkit includes the following information: * A poster to display in your office to get employees talking with agency HR and Payroll shops about provisions typically used when a person needs to take time off for their own injury or illness or that of a family member. These changes are effective with December payrolls paid January 1, 2011. Source information is contained in the following. IRS Publication 1036 http://www.irs.gov/pub/irs-pdf/n1036.pdf Defines the change in Social Security tax for employees reducing the tax from 6.2% downward to 4.2%. The employer portion of Social Security tax remains at 6.2%. The 2011 Social Security wage base limit is $106,800. Federal withholding calculations are defined in the publication both in terms of the value of a withholding allowance (Page 1) and the actual percentage calculation of tax withholding (Table 4 on Page 3) OSPS will watch for the posting of Publication 15 (Circular E) for tax year 2011 and notify everyone. Publication 15 will contain all of the information in 1036 but will also have the tax tables as well as all of the other relevant tax advisories and rules. We note that Publication 15-B Taxable Fringe Benefits for 2011 has already been posted. http://www.irs.gov/pub/irs-pdf/p15b.pdf Oregon Withholding Tax Formulas http://www.oregon.gov/DOR/forms/business/withholding_formulas_150-206-43 6_2011.pdf New this year is a phase-out of the subtraction for federal tax withheld for annual incomes of $125,000 or greater. OSPA has been programmed with the Monthly formulas shown on Pages 5 & 9. We are told that DOR will update this tax publication soon to add the display of tax tables for easy reference.
