We appreciate the participation of school bus operators, school districts, contractors, state associations, and state directors and their staff. Your combined efforts in this fourth annual survey were critical to our continued efforts to mitigate these unacceptable violations by motorists and reduce the threat they pose to the safety of school bus riders. In 29 states throughout the country, school bus drivers recorded in a one-day snapshot how many times other motorists passed their school buses illegally while the buses were stopped displaying their flashing red lights and stop arms. Over 97,000 school bus drivers reported that 75,966 vehicles passed their buses illegally on a single day. Throughout a 180-day school year, these sample results alone point to over 13 million violations by private motorists. This is truly a dangerous situation and we all share the responsibility to do all we can to help eliminate this threat to the students riding our school buses. This update is required because of changes to State and Federal rules. As a result, ODE is requiring that behind-the-Wheel Trainers recertify under Oregon Administrative Rule (OAR) 581-053-0100. Today, ODE has mailed every certified Behind-the-Wheel Trainer the attached letter, along with a CD containing the revised manual. It is very important for your trainers to print the manual and follow the instructions contained in the letter. Recertification will be done via an online exam through iLearn Oregon (http://ilearn.oregon.gov). After they complete the recertification process, they will be able to print out a certificate that indicates completion. This certificate should be kept with the trainer's training and/or personnel file. Trainers will be notified directly by email through the iLearn website once the training / testing is uploaded and ready. Trainers will need to recertify by October 1, 2014 or their Behind-the-Wheel Training Certificate will become invalid. A trainer with an invalid certificate cannot train or test drivers. This update also requires that third-party test routes are revised to current standards and submitted. ODE will only support the renewal of third-party examiners who have completed the BTW recertification and are from locations that have submitted new test routes that have been approved by ODE. If a trainer is unable to recertify by October 1, they will still have opportunity to do so until December 31, 2014. Once recertified, they can resume the training and testing. As soon as a trainer has recertified, they should begin teaching the new material. Testing criteria will switch to the new standard on October 1, 2014. Along those same lines, and with Labor Day quickly approaching, I would like to remind everyone to make sure your applications for school bus certificates are current to meet your demands for the upcoming school year. Please don't wait until the last minute to send in your applications. Similar to last year, we are anticipating an increase in the volume of applications during the latter part of August, and I want to remind everyone it can take up to two weeks to process an Application for School Bus Driver Permit or Certificate (State form 581-2278b). This is due in large part for the need to process documents via the U.S. Postal Service. The volume of applications and turnaround time in August has created another problem with the Request for Approval of Temporary School Bus Driver (State form 581-2240-M). In the final weeks before the start of school, the requests for temporary school bus drivers will take approximately 48 hours to process from the time they have been received here at the department. Depending on the number of Temporary requests, if you wait until the last days in August there is a chance you may not have all your drivers available to drive when school starts the following Tuesday. Again, it just depends on the number of last-minute requests we receive, so please plan accordingly. Please note: Temporary requests received by noon on Thursday, August 28, 2014, should be completed and returned to you by the start of school on Tuesday, September 2, 2014. Please know we are doing everything we can to accommodate the increased workload. Good news: We recently started working on an online system to process permits and certificates, but that project will take some time to implement, so we appreciate your patience in the meantime. Also, please plan accordingly for your activity drivers. The department does not have a temporary request process for activity drivers, so please make sure you allow one to two weeks for processing when sending in the Approval Request for Drivers of Type 10 Non-school Bus Pupil Transporting Vehicles (State form 581-2279-M) and the Application for Type 20 Driver's Certificate (State form 581-1276-M). The newly revised form can be found online at http://www.ode.state.or.us/search/page/?=1114. We will continue to accept the old version of this form for 11-14 passenger certificates until November 1, 2014. 15-20 passenger certificates will need to be submitted on the new version starting immediately. Similar to the program offered in 2012, this is a rebate program, effectively working like a raffle with awards offered randomly among qualifying requests. Only one Oregon school district was successful in 2012 (but among all west coast states). This time there is a guarantee of at least one award from applications submitted from the Pacific Northwest states. Application deadline is November 17, 2014 at 4:00 PM EST. For more information about the program details and application forms go to http://www.epa.gov/cleandiesel/dera-rebate-schoolbus14.htm Who can apply? School districts, tribal agencies, private contractors under contract to a public entity. Private schools and other organizations are not eligible. What vehicles are eligible for replacement? * Diesel-powered Class 3 through Class 8 school buses powered by a 2006 or older engine model year are eligible for replacement; * Able to start, move in all directions, and have all operational parts; and * Have accumulated at least 10,000 or more miles over the most recent 12 months, or been in use for at least three days per week during the current school year. How many buses can I apply for? Applicants may submit only one rebate application but it can include up to five eligible replacement buses. How difficult is it to apply? The application is a one page form. The applicant must show they own and operate the school bus, so a copy of title and registration is also required. That's it! The Oregon Department of Education wants to remind you and your school bus drivers that other state and federal rules continue to prohibit the use of marijuana by bus drivers. OAR 581-053-0040 states that school bus drivers are qualified only if they do not use any controlled substance identified in 21 CFR 1308.11 Schedule 1. Marijuana continues to be on the Schedule 1 list. This language is consistent with federal regulations under 49 CFR 391.41 that applies to all CDL drivers. CDL drivers will continue to be tested for marijuana as part of DOT drug testing required by 49 CFR part 382. The presence of marijuana will result in a positive drug test and drivers will not be able to resume driving until they see a substance abuse professional and complete the return-to-duty process. This can be a lengthy and costly endeavor. Random drug tests can still be conducted year round. Depending on the amount and frequency of use, marijuana can remain in the system for up to 90 days. As measure 91 is phased in, please remind your drivers of these facts so Oregon can continue its excellent safety record in pupil transportation. If you should have any questions, please contact T.J.
