Please find attached a brief memo explaining the Department's review of the issue and why we did not address it in rule. As many of you know, the question was then taken up in the legislature. HB 2622, now enrolled, adjusts ORS 469A.010 to allow certain facilities to qualify for the Renewable Portfolio Standards. I understand that stakeholders discussed this issue in depth during the rulemaking. We wanted to circle back with this memo and update in order to provide closure.
