Below you will find information on two proposed amendments for rules for special education (and others).  The first one related to Emotional Disturbance is a minor typo recently discovered and the second one relates to Rosa's Law. NOTICE OF ADMINISTRATIVE RULEMAKING FOR PROPOSED ADOPTION BY THE STATE BOARD OF EDUCATION


OAR 581-015-2145 - Emotional Disturbance Criteria: This proposed change in OAR 581-015-2145 brings this rule in alignment with the federal defintion of a child with an emotional disturbance disablity (34 CFR 300.8(c)(4)(i)(A)).

OAR's 581-015-2000, 2155, 2120, 2390; 581-016-0536, 0740; 581-019-0005; 581-023-0100: Changes in Special Education Terms to modify terminology from "mental retardation" to "intellectual disability" for persons with an intellectual disability.

When an agency proposes to adopt, amend or repeal a rule, it shall give interested persons reasonable opportunity to submit data or views. Comments can be emailed to ODE.RuleTestimony at state.or.us<mailto:ODE.RuleTestimony at state.or.us>  . Written or electronic testimony accepted until Sept. 30, 2011 - 5:00 p.m.

Due to budget reductions the Department of Education is no longer conducting a separate hearing on each rule. However, interested parties may provide written comments to the Department or provide oral comments directly to the State Board of Education during the board's public comment period at the first meeting at which the rule is on the board's agenda. Additionally, opportunity for oral hearing shall be granted upon request received from 10 persons or from an association having not less than 10 members before the earliest date that the rule could become effective after the giving of notice.
