The Oregon Renewable Portfolio Standards accepts output from certified low-impact hydroelectric facilities, if owned by an Oregon utility, for projects that began operation prior to January 1, 1995. [Refer to Oregon Revised Statute 469A.010 at www.leg.state.or.us/ors/469a.html.] 

Outside of this provision, only facilities (or qualified improvements to older facilities) that began operation on or after January 1, 1995 are accepted for the Oregon RPS. Of course, all facilities are subject to other provisions of the law.

The Oregon Department of Energy must adopt, by rule, a national certification organization for low-impact certification. [ORS 469A.010 (4)]

To prepare for a rulemaking, the Department will discuss this issue with stakeholders during a meeting of the Oregon Hydro Working Group on Thursday, October 23, 2008. A call-in option will be available for the meeting.
