[Boli_rules] BOLI Notices of Proposed Rulemaking Hearings - Wage and Hour Division

On September 26, 2019, the Bureau of Labor and Industries filed with the Oregon Secretary of State a Notices of Proposed Rulemaking Hearings for amendments to rules related to the following measures:

*       House Bill 2593 - Expression of Milk

o   Proposed amendments: Amends OARs related to rest periods for the expression of milk that included language that directly mirrored statutory language repealed by HB 2593 and limited application the law to covered employers. Therefore, the proposed amendments regarding rest periods for expression of milk are only for the purpose of aligning directly with the statutory changes.

*       House Bill 3193 - Increase cap on Wage Security Fund from $4,000 - $10,000

o   Proposed amendment: Changes the OAR regarding the amount that a wage claimant can receive from the WSF from "$4,000" to "$10,000."

*       Property Service Contractors - Increase licensing fee from $250 - $350

o   Proposed amendment: The Bureau of Labor and Industries budget bill (SB 5516) requires an increase in the property services contractors fee in order to fund a half-time Office Specialist 2 position to provide additional support for the property services contractor licensing program.


We have scheduled public hearings on October 17th to receive input on each of the amendments to the administrative rules and all comments are due by October 21, 2019 at 5 pm.
A copy of the Notice of Hearings and proposed rules are enclosed.
