On March 22, 2021 the Labor Commissioner received a petition requesting amendment to the Bureau of Labor and Industries (BOLI) Oregon Administrative Rules (OAR). Pursuant to ORS 183.390<https://www.oregonlaws.org/ors/183.390> and OAR 137-001-0070<https://secure.sos.state.or.us/oard/viewSingleRule.action?ruleVrsnRsn=9849> petitioners request an amendment to OAR Chapter 839, Division 20 - Meal and Rest Periods.

In accordance with ORS 183.390 and OAR 137-001-0070, upon receipt of a petition requesting that a rule be amended, BOLI sought public comment on the proposed amendment to the rule, specifically public comment on whether options exist for achieving the rule's substantive goals in a way that reduces the negative economic impact on businesses.

There was a 30-day public comment period; the public comment closed at 5:00 pm on May 21, 2021.

The public comments are posted for review: https://www.oregon.gov/boli/about/Pages/rulemaking.aspx

Upon completion of the public comment period, BOLI will make a determination whether deny the petition or initiate rulemaking proceedings. The agency must complete this process no later 90 days after the date of submission of a petition.
