Good Morning,
 
Hopefully, some of you had an opportunity to listen to the broadcast on
OPB's "Think Out Loud" this morning regarding Domestic Violence.
 
Rep. Holvey was one of the guests on this morning's show.
 
He is introducing four bills regarding DV issues and briefly outlined
what they are.
 
In case your interested, here's a little more information about them:
 
HB 2925: Requires the court to enter order prohibiting defendant from
contacting the victim when defendant is arraigned on sex crime or crime
constituting domestic violence. Authorizes court, at victim's request,
to enter additional order at sentencing for period of time equal to
statutory maximum sentence from crime. Authorizes victim to petition for
termination of order. (This bill is meant to fill the gap when a
defendant is in-custody and therefore has no "release agreement"
prohibiting contact with the victim and/or the situation when defendant
completes term of probation and there is no other means for a "no
contact" provision with the victim). (Rep. Thatcher has also introduced
a similar bill--HB 2766)
 
HB 2927: Creates statewide interdisciplinary domestic violence fatality
review team. Would require biennial report to Legislative Assembly.
(Currently, there is a statute that authorizes a statewide DV fatality
panel, but the statute is fairly vague and is discretionary).
 
HB2928: Authorizes hearings under FAPA to be held in person OR by
telephone
 
HB2931: Requires court to order, if requested by Petitioner, that
Respondent in FAPA proceeding be restrained from electronic tracking of
Petitioner or Petitioner's children. Defines contact that can be
prohibited in stalking order to include electronic tracking
 
Also, HB 2931 (Reps Gelser and Sheehan): Increases penalty for crime of
strangulation to maximum of five years' imprisonment, etc. Directs
Oregon CJC to classify crime as level "8" if Defendant has previously
been convicted for strangulation, otherwise level "4".
