Subject: IMPORTANT UPDATE: Vaping product rules stayed

Dear local public health administrators, health officers, and tribal health directors,

Last week, the Court of Appeals ruled that the stay on OHA's non-THC flavored vaping product rules will remain in place. This means that the nicotine flavor ban continues to be unenforceable and will continue to be for the near future.  OHA will be talking with the Department of Justice about next steps and will keep you informed of any updates.

Also last week, the Court of Appeals also stayed the Oregon Liquor Control Commission's flavored cannabis vaping product rules. The Oregon Medical Marijuana Program flavored cannabis vaping product rules remain standing and will continue to be enforced.

OHA will continue to implement the remainder of Executive Order 19-09 and will communicate regularly with local and tribal tobacco prevention and education program staff on progress as well.
