Marine Board Seeks Public Comment on Proposed Rule for Breath Testing Instruments

            The Oregon State Marine Board seeks public comments on a proposed rule to remove reference to specific breath testing instrument models in administrative rule and replace the references to "breath testing instruments."  The comment period opens December 1.
            The proposed rule would amend OAR 250-010-0430 and 250-010-0450 to eliminate references to the Intoxilyzer 5000, Intoxilyzer 1400 and Draeger AlcoTest EPAS (Evidential Portable Alcohol System) Plus.
            Written public comment will be accepted December 1 through December 31, 2010.  Written comments can be submitted via email to osmb.rulemaking at state.or.us<mailto:osmb.rulemaking at state.or.us> or by U.S. mail to June LeTarte, Rules Coordinator, 435 Commercial Street NE, Suite 400, P.O. Box 14145, Salem, OR 97309-5056.  Comments via telephone cannot be accepted.
