Marine Board Approves New Rules for Aquatic Invasive Species Permit Program, BUII, and Other Items

                The Oregon State Marine Board met Thursday, January 13 in Portland and approved two new rules for recreational boaters: The first, allow more permit purchasing options for paddlecraft in the aquatic invasive species prevention program; and the second, eliminate references to outdated models of breath testing instruments.
            The Board unanimously approved a proposed rule that offers paddlers the choice of purchasing a two-year aquatic invasive species (AIS) prevention permit in addition to purchasing a one-year, paper permit.  Permits are valid for a given calendar year.  The biennial permits will be available for sale through the Marine Board office in Salem in mid-February.   Registered boats with the Marine Board automatically pay into the AIS fee when they renew their registration and a current decal represents compliance.
The Board also unanimously approved eliminating the reference in two administrative rules that specify models of breath testing equipment to a more-encompassing term, "breath testing equipment."  Breath testing instruments are used for testing boat operators for the presence of alcohol in their breath if a marine officer has probable cause to believe the operator is boating under the influence of intoxicants (BUII).
Marine Board staff asked the Board to consider rulemaking in two locations: Foster Reservoir in Linn County and the Rogue River in Jackson County.  The Board approved moving forward with the public input process for boat operations on Foster Reservoir that would establish a 100' slow no-wake zone around the Edgewater RV Resort and Marina.  This area was designated a slow no-wake zone under a temporary rule in 2010.  The Board also approved to initiate permanent rulemaking on the Rogue River relating to the Gold Ray and Savage Rapids Dam removals.  On January 3, 2011, the agency adopted temporary rules to eliminate reference to the Gold Ray and Savage Rapids dams which are effective through June 30, 2011.
The Board addressed a last-minute agenda item regarding the Portland-Milwaukie Light Rail Bridge Project slated to begin construction for this summer between the Marquam and Ross Island bridges.  Tri-Met representatives and contractors (Kiewit and T.Y. Linn International) presented the Board with the scope of the project, timelines for the in-water work, safety concerns, and schematics of the construction.  Tri-Met requested the Board consider a bank-to-bank, slow no-wake zone for 500 feet on either side of the bridge project -with an exclusion zone under the temporary work bridge, during construction from June 2011 through December 2012.  The Board approved moving forward with public input and emphasized the importance of timely outreach, strong coordination, and proper signage of the safety hazards while the project is underway and keeping as much of the waterway as possible, open to boaters.
