Marine Board Enacts Temporary Rule for Holgate Channel

            The Marine Board filed for a temporary rule for the Holgate Channel on the Willamette River in Multnomah County to remove an overly broad exemption for commercial vessels which is not statutorily allowed in ORS 830.015.  The temporary rule took effect on January 1, 2012.
            By eliminating the commercial vessel exemption, commercial passenger vessels less than 100 gross tons must abide by, and cannot be exempted from, rules enacted by the Oregon State Marine Board in waters of the state when there are no conflicting federal waterway rules or regulations.
            Staff will initiate a permanent rulemaking request at the Marine Board's next quarterly meeting, scheduled for January 12 at 9 am at the Portland Expo Center.
