In 2010, changes were made to the interpretation and application of donated hardship leave requests.  The 2010 interpretation required employees to request donated hardship leave prior to going into leave without pay status.  Based on employee need and agency feedback, we have revisited this interpretation and determined it too restrictive.

Effective immediately, employees who meet the eligibility requirements for donated hardship leave outlined in policy and/or relevant collective bargaining agreement, may request donated leave prior to or during leave without pay status.

While agencies can request hardship donations if an employee is in LWOP status, the intent is not to allow employees to retroactively request and receive donated leave to be applied to a month in which the time has locked.  Further, an employee may not choose when to use donated leave and go in and out of leave without pay.  Example:  Eligible employee receives 120 donated hours and asks to use 30 hours in July and retain 90 for use in the month of August. Employee must use the hours donated and request additional hours for any qualifying subsequent months.

If an employee's request does not generate enough donations to cover the entire month, the agency may further solicit donations within the same month, or subsequent months, regardless of whether the employee is in LWOP.
