Subject:           Employees with Excess Vacation Leave Resulting from HB 2020 or 4131

Management, Unclassified and Classified Unrepresented Service employees affected by HB 2020 or 4131 may experience a decrease in the maximum accrual cap for their vacation hours if they are changed to represented or unrepresented status.  For example, management service employees may accrue up to 350 vacation hours, but SEIU represented employees may accrue up to 325 vacation hours.  We encourage agencies to permit these employees to use their excess vacation hours prior to their change of class or REPR codes.

However, in the event an employee is unable to use their excess vacation, agencies should place all vacation hours that are above the employee's new vacation balance maximum into the employee's Personal Business Leave account.

Statewide Payroll will enable the payroll system to allow these hours to be accepted starting October 17, 2012. Agency payroll will need to manually transfer the excess vacation leave hours before employees are reclassified or subject to a REPR code change.  If employees have already experienced a loss in vacation leave due to HB 2020 or 4131, agencies should place the equivalent of the lost vacation leave hours into the employee's Personal Business Leave account.  If you are unable to access the employee's Personnel Business Leave account, please contact the Statewide Payroll Services Help Desk for assistance.

Employees will be able to use this leave as they would Personal Business Leave. This leave must be used by June 30, 2013 or it will be lost.
